(ORAL)<\/p>\n<p>            This is a petition under Section 482 Cr.P.C. for quashing of FIR<\/p>\n<p>No. 106 dated 20.10.2001 (Annexure P-I) registered under sections<\/p>\n<p>498A\/406\/109 IPC at police station Nathana, district Bathinda and all<\/p>\n<p>subsequent proceedings arising therefrom on the basis of compromise.<\/p>\n<p>            Both petitioner No. 1 i.e. husband and respondent No. 2 i.e.<\/p>\n<p>wife are present in Court. Both of them have stated that they are now living<\/p>\n<p>together and have compromised the matter. The complainant\/respondent<\/p>\n<p>No. 2 has stated that she has no interest in pursuing the FIR in question and<\/p>\n<p>thus the same be quashed on the basis of compromise. The affidavit is taken<\/p>\n<p>on record as mark &#8216;A&#8217;. They have been duly identified by their respective<\/p>\n<p>counsel.   Learned counsel for the respondent No. 2 has stated that an<\/p>\n<p>affidavit has been filed on behalf of the complainant\/respondent No. 2 in<\/p>\n<p>which it has been stated that petitioners and respondent No. 2 have<br \/>\n<span class=\"hidden_text\"> Crl. Misc No. M-30014 of 2008                                        -2-<\/span><\/p>\n<p>compromised the matter.\n<\/p>\n<p>             The compromise is in the interest of the parties and after the<\/p>\n<p>matter has been resolved by an amicable settlement, no useful purpose is<\/p>\n<p>likely to be served with continuance of the criminal proceedings.<\/p>\n<p>             In view of the above, the present FIR and the consequent<\/p>\n<p>proceedings arising therefrom deserve to be quashed in the light of the<\/p>\n<p>decision of Full Bench of this Court in Kulwinder Singh and others Vs.<\/p>\n<p>State of Punjab, 2007 (3) RCR(Crl.), 1052.\n<\/p>\n<p>             Resultantly the present petition is allowed, the FIR in question<\/p>\n<p>and the subsequent proceedings arising therefrom are quashed.<\/p>\n<pre>23.03.2009                                              (RAJAN GUPTA)\nAjay                                                       JUDGE\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Sukhpal Singh And Others vs State Of Punjab And Another on 23 March, 2009 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH Crl.
