KRUTI M SHAH for Applicant(s) : 1, \nMR HL JANI,\nADDL.PUBLIC PROSECUTOR for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.B.ANTANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/03\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>\t\tThis<br \/>\nis an application preferred under Section 438 of the Code of Criminal<br \/>\nProcedure, 1973 by the applicant who is apprehending his arrest in<br \/>\nconnection with  CR No. I-386 of 2009 registered with Fatehganj<br \/>\npolice station, Vadodara City, for the offence punishable under<br \/>\nSections 307, 323, 504, 143, 147, 148 and 149 of Indian Penal Code.\n<\/p>\n<p>\t\tMr.\n<\/p>\n<p>N.D. Nanavati, learned Sr. Advocate, appearing with Ms. Kruti M Shah<br \/>\nfor the applicant submitted that the applicant is an innocent person<br \/>\nand he has not committed any alleged offence as narrated in the FIR.<br \/>\nThe applicant was present when the incident in question took place<br \/>\nand he gave one baseball stick blow on the back of the complainant.<br \/>\nConsidering the aforesaid role, the applicant deserves to be granted<br \/>\nanticipatory bail as prayed for in the application.\n<\/p>\n<p>\t\tLearned<br \/>\nSr. Advocate has placed reliance on the judgment of the Apex Court in<br \/>\nthe case of  Harpreet Singh v. Govt. of NCT of Delhi, reported in<br \/>\n[2005] 11 Supreme Court Cases 551, in support of the submission<br \/>\nthat the applicant is a student and considering the fact that there<br \/>\nis no criminal antecedent, prayer for anticipatory bail deserves to<br \/>\nbe considered.\n<\/p>\n<p>\t\tLearned<br \/>\nAPP Mr. H.L. Jani, representing the opponent Sate, while opposing the<br \/>\nanticipatory bail application, submitted that considering the role<br \/>\nattributed to the applicant as reflected in the FIR at Annexure:A to<br \/>\nthe application, the applicant was present at the scene of offence<br \/>\nand he also participated in the assault which was committed by him<br \/>\nalong with other accused on the complainant. The applicant was armed<br \/>\nwith baseball stick and gave  blow on the back portion of the<br \/>\ncomplainant. Thus, when prima facie involvement of the applicant is<br \/>\nindicated, discretionary relief in favour of the applicant may not be<br \/>\ngranted and the application deserves to be rejected.\n<\/p>\n<p>\t\tI<br \/>\nhave considered the rival submissions canvassed by the learned<br \/>\ncounsel of both the sides and the written submissions given by the<br \/>\napplicant.  The applicant is involved in the offence punishable under<br \/>\nsections  307, 323, 504, 143, 147, 148 and 149 of IPC. On perusal of<br \/>\nthe FIR, the role attributed to the applicant becomes clear. The<br \/>\napplicant, was present at the scene of offence when the scuffle took<br \/>\nplace. He was armed with  baseball stick and gave stick blow on the<br \/>\nback portion of the complainant. Thus, participation of the applicant<br \/>\nis also indicated on perusal of the record of the case and<br \/>\nconsidering the aforesaid aspect, the applicant, in my view, would<br \/>\nnot be entitled to claim anticipatory bail as prayed for in the<br \/>\napplication.  I have also considered the  judgment cited by the<br \/>\napplicant. There is no dispute about the ratio  or proposition  laid<br \/>\ndown by the Apex Court. However, the said judgment would not be<br \/>\nhelpful to the applicant in this case. This Court is also aware of<br \/>\nthe fact that powers under Section 438 of the Code can be exercised<br \/>\nonly in exceptional and rare circumstances. Considering the<br \/>\ninvolvement of the applicant, his case, in my view, would not  fall<br \/>\nunder the exceptional category.\n<\/p>\n<p>\t\tFor<br \/>\nthe foregoing reasons, there is no merit in the application and the<br \/>\nsame is hereby rejected.
