Justice ANTONY DOMINIC\n\n Dated :16\/10\/2007\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                     ===============\n                  W.P.(C) NO. 28598 OF 2007 D\n                =====================\n\n           Dated this the 16th day of October, 2007\n\n                          J U D G M E N T\n<\/pre>\n<p>      The petitioner is an assignee of 6th respondent.       The 6th<\/p>\n<p>respondent and others were partners of a firm, which had<\/p>\n<p>defaulted in paying their dues to the 4th respondent. In view of<\/p>\n<p>the fact that he is an assignee of the 6th respondent, the<\/p>\n<p>petitioner apprehends that revenue recovery action, which has<\/p>\n<p>originally initiated against the 6th respondent will be continued<\/p>\n<p>against him also.\n<\/p>\n<p>      2.    According to the petitioner, he is a bonafide purchaser<\/p>\n<p>and as the partners themselves are in possession of sufficient<\/p>\n<p>resources to discharge their liabilities, in fairness, action should<\/p>\n<p>be initiated at least at the first instance against the partners of<\/p>\n<p>the firm.   With this prayer, petitioner has submitted Ext.P10<\/p>\n<p>representation to the 3rd respondent, which is pending his<\/p>\n<p>consideration.     Petitioner is also relying on Division Bench<\/p>\n<p>judgment of this Court in St.Arnold Divine Works Society v.<\/p>\n<p>State of Kerala (2006(3) KLT S.N. Case No.67), where this<\/p>\n<p>WPC 28598\/07<br \/>\n<span class=\"hidden_text\">                                : 2 :<\/span><\/p>\n<p>court has held as follows:\n<\/p>\n<blockquote><p>    Petitioner is a bonafide purchaser who purchased the<br \/>\n    property for valid consideration before attachment and,<br \/>\n    therefore, that property cannot be sold for the purpose<br \/>\n    of the dues of the defaulter.         Petitioner is not a<br \/>\n    guarantor, but, he is a total stranger to the defaulter.<br \/>\n    He, being a bonafide purchaser, the revenue recovery<br \/>\n    proceedings taken against the petitioner is wholly<br \/>\n    unwarranted.<\/p><\/blockquote>\n<p>     In view of the fact, it is the petitioner&#8217;s specific contention<\/p>\n<p>that the partners of the firm themselves have enough resources<\/p>\n<p>to meet the liability, it is only proper that this prayer is<\/p>\n<p>considered in the light of the law as laid down in the judgment<\/p>\n<p>referred to above.\n<\/p>\n<p>     3.
