While considering the\n\nsame,   with        the    consent       of     parties,       the     matter     is\n\nfinally heard at this stage.\n\n\n\n               By   this     petition         for       writ   a    challenge    is\n\ngiven to the validity, propriety and correctness of\nthe award dated 17.11.2004 passed by the Labour Court,\n\nUdaipur        answering      the        reference         made       to   it     by\n\nappropriate         government       under          a    notification          dated\n\n9.4.1997.\n\n\n\n               In brief, facts of the case are that as a\n\nconsequent       to   regular       selection            process      appointment\n\nwas   accorded        to    the     petitioner            as   Conductor        with\n\nRajasthan State Road Transport Corporation in the pay\n\nscale     of     Rs.490-840         on        probation.           Initially     the\n\nappointment was for a period of one year. The employer\n                                          2\n\ncorporation terminated the petitioner from service on\n\n6.5.1986.        An      industrial            dispute           to     challenge\n\ndiscontinuation from service was raised and that was\n\nreferred for          its    adjudication to              the    Labour Court,\n\nUdaipur. The Labour Court, Udaipur after considering\n\nentire     evidence          available          on       record       held        that\n\ntermination of the workman was bad, however, instead\n\nof granting the relief of reinstatement allowed him\n\nthe wages of three months and eight days i.e. the\n\nperiod falling short in one year services given under\n\nthe order dated 28.1.1986.\n\n\n\n            While           assailing         validity          of    the     award\n\naforesaid    it         is     contended            by    counsel       for        the\n\npetitioner that the Labour Court erred while denying\n\nthe benefit of reinstatement to the petitioner in view\n\nof the fact that the appointment under the order dated\n\n28.1.1986    was       not    for    a       term    of    one       year    but    on\n\nprobation for a period of one year. It is also pointed\n\nout by counsel for the petitioner that all the persons\n\nemployed alongwith him under the order dated 28.1.1986\n\nwere allowed to continue in services beyond the term\n\nof one year and, most of them are still continuing in\n\nservice.    It     is       also    asserted         by    counsel          for    the\n\npetitioner that adequate evidence was adduced before\n\nthe Labour Court to establish the continuance of other\n\nConductors in service who were employed alongwith the\n\npetitioner on 28.1.1986.\n                                         3\n\n            An additional affidavit has been filed on\n\nbehalf    of     the       respondents        sworn-in     by    Shri       Ashok\n\nThanvi, officer-in-charge of the case making a solemn\n\nstatement that on verification of service record it\n\nwas found that the candidates who were appointed at\n\nChittorgarh Depot alongwith the petitioner are still\n\nworking.    In        the    affidavit        aforesaid        names   of    the\n\npersons     appointed              alongwith       the     petitioner         at\n\nChittorgarh Depot are also given. It is also stated\n\nthat    certain       other        persons    whose      names    appears     at\n\nSerial Nos.9, 24, 36, 40, 52 and 54 in the order dated\n\n28.1.1986 are also still working at Udaipur Depot in\n\npursuant to the order dated 28.1.1986. The admission\n\nof the fact that the persons employed alongwith the\n\npetitioner are still continuing with the respondents\n\nin     pursuant       to     the    order     dated      28.1.1986      itself\n\nestablishes       it        well    that     the   appointment         of    the\n\npetitioner was not for one year but was on probation\n\nfor one year. As a matter of fact the finding given by\n\nthe Labour Court is running even contrary to the stand\n\ntaken by the employer. Further it is relevant to note\n\nthat in the order of appointment dated 28.1.1986 the\n\nreference of probation is given in the note itself. A\n\nperson recruited through regular process of selection\n\nis required to be employed on regular basis and that\n\nmay be on probation for specific term.\n\n\n\n              For   the   reasons       above,      this    petition    for\n\nwrit deserves acceptance and, therefore, the same is\n\nallowed.      The   award    impugned         dated        17.11.2004    is\n\ndeclared illegal to the extent it allows only wages\n\nfor a period of three months and eight days to the\n\npetitioner workman in lieu of reinstatement.
