This writ petition has been filed for the following<\/p>\n<p>                   reliefs :-\n<\/p>\n<blockquote><p>                                (A) For issuance of a writ in the nature of certiorari or<br \/>\n                                   any other appropriate writ, order\/s, direction<br \/>\n                                   quashing the entire certificate case no. 153\/03<br \/>\n                                   including the order dated 14.08.2009 passed by<br \/>\n                                   respondent no.7 whereby and whereunder the<br \/>\n                                   objection filed by the petitioner u\/s 9 of Bihar &amp;<br \/>\n                                   Orissa Public Demand Recovery Act was rejected<br \/>\n                                   without considering all the relevant points including<br \/>\n                                   the letter dated 10.03.2008 issued under the<br \/>\n                                   signature of the Finance Minister, Government of<br \/>\n                                   India, New Delhi directing respondent no.3 that<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>              Government of India has waived all agricultural<br \/>\n              loans taken from 15th August to 31st July, 2007 in<br \/>\n              respect of all agriculturists having agricultural lands<br \/>\n              up to five acres (Annexure 8).\n<\/p><\/blockquote>\n<p>          (B) For issuance of a writ in the nature of mandamus or<br \/>\n              any other appropriate writ, order\/s, direction<br \/>\n              commanding the respondents for the followings :-\n<\/p>\n<p>              (i) To treat Annexure 8 to the petition to be nullity<br \/>\n                   and non-est in the eye of law.\n<\/p>\n<p>              (ii) To implement the policy decision of            the<br \/>\n                   Government of India, New Delhi as contained in<br \/>\n                   letter dated 10.03.2008 (Annexure 4) in the State<br \/>\n                   of Bihar in general and in the case of the<br \/>\n                   petitioner in particular.\n<\/p>\n<p>              (iii) To treat the agricultural loan in question taken<br \/>\n                   by the petitioner to have been waived of in view<br \/>\n                   of the policy decision of      the Government of<br \/>\n                   India as contained in letter dated 10.03.2008<br \/>\n                   issued under the signature of the Finance<br \/>\n                   Minister, Government of India, New Delhi.<br \/>\n              (C) For any other relief\/s to which the petitioner is<br \/>\n                   found entitled to.\n<\/p>\n<p>              3. It is quite apparent that in response to notice<br \/>\nissued under section 7 of the Bihar &amp; Orissa Co-operative<br \/>\nSocieties Act, 1914 (hereinafter referred to as `the Act&#8217; for the<br \/>\nsake of brevity)      in Certificate Case No. 153 of 2003, the<br \/>\npetitioner had filed his objection under section 9 of the Act, which<br \/>\nwas rejected by the authorities by             impugned order dated<br \/>\n14.08.2009 (Annexure 8) and recovery notice under section 17 of<br \/>\nthe Act was directed to be issued. About eleven months thereafter<br \/>\nthe instant writ petition has been filed by the petitioner although<br \/>\nthe matter in issue involves question of facts, which are disputed<br \/>\nand an appeal is specifically provided under the Act against the<br \/>\nimpugned order, which has been passed under section 10 of the<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>       Act.\n<\/p>\n<p>                     4. In the said circumstances, there is no occasion for<br \/>\n       the petitioner to approach this Court as adequate and proper<br \/>\n       remedy for him was to file an appeal before the appellate<br \/>\n       authority, who was fully entitled to consider all the issues<br \/>\n       involved in the matter or raised by the petitioner.\n<\/p>\n<p>                     5. In the said circumstances, this Court does not find<br \/>\n       any reason to interfere in the matter and this writ petition is,<br \/>\n       accordingly, dismissed. However, the petitioner will be entitled to<br \/>\n       approach respondent-Bank for One Time Settlement if such<br \/>\n       Settlement is legally permissible.\n<\/p>\n<pre>MPS\/                             ( S.
