\n\tadvocate for the applicants seeks permission to withdraw this
\n\tapplication, at this stage, qua applicant No.1. Permission is
\n\tgranted.  This application stands disposed of as withdrawn qua
\n\tapplicant No.1.\n<\/p>\n

\n\tcounsel for the applicant submits that applicant No.2 is a lady
\n\taccused and she had tried to save the deceased by hospitalizing him.
\n\t It is further submitted that the applicant has roots in the
\n\tsociety, will not flee from justice and will cooperate with the
\n\tinvestigation as and when called for.  It is further submitted that
\n\tson of the applicant is studying in Standard-X and considering the
\n\toverall facts and circumstances of the case and the allegations
\n\tlevelled against the applicant are Magistrate triable, the applicant
\n\tmay be granted anticipatory bail.\n<\/p>\n

Having
\n\theard learned counsel for the parties and perusing the record of the
\n\tcase and taking into consideration the facts that, applicant No.2 is
\n\ta lady accused, who had tried to save the deceased by hospitalizing;
\n\tson of the applicant is studying Standard-X; the case is a
\n\tMagistrate triable; and considering other attending circumstances,
\n\twithout discussing the evidence in detail, at this stage, I am
\n\tinclined to grant anticipatory bail to the applicant.    This Court
\n\thas also taken into consideration the law laid down by the Apex
\n\tCourt in the case of Siddharam Satlingappa Mhetre v. State of
\n\tMaharashtra & Ors. Reported<\/a> in [2011]1 SCC 694, wherein
\n\tthe Apex Court reiterated the law laid down by the Constitutional
\n\tBench in the case of Shri Gurubaksh Singh Sibbia & Ors.
\n\tReported in [1980]2 SCC 565.\n<\/p>\n

In
\n\tthe result, this application is allowed by directing that in the
\n\tevent of the applicant No.2 herein being arrested pursuant to FIR
\n\tbeing CR No.II-99\/2011 with Mahila Police Station,  Rajkot for the
\n\toffences punishable under sections 498 and 114 of the IPC, the
\n\tapplicant shall be released on bail on furnishing a bond of
\n\tRs.10,000\/- (Rupees Ten Thousand only) with one surety of like
\n\tamount on following conditions :-\n<\/p>\n
[a]\tshall
\ncooperate with the investigation and make himself \tavailable \tfor
\n\tinterrogation whenever required.\n<\/p>\n
[b]\tshall
\nremain present at concerned Police Station on  19.7.2011 between
\n11:00 am to 2:00 pm:\n<\/p>\n
[c]\tshall
\nnot hamper the investigation in any manner nor shall directly or
\nindirectly make any inducement, threat or promise to any witness so
\nas to dissuade them from disclosing such facts to the Court or to any
\nPolice Officer;\n<\/p>\n
[d]\tshall
\nat the time of execution of bond, furnish the address to the
\nInvestigating Officer and the Court concerned and shall not change
\nthe residence till the final disposal of the case or till further
\norders;\n<\/p>\n
[e]
\n\twill not leave India without the permission of the Court and, if is
\nholding a Passport, shall surrender the same before the trial Court
\nimmediately;\n<\/p>\n
[f]\tIt
\nwould be open to the Investigating Officer to file an application for
\nremand, if he considers it just and proper and the concerned
\nMagistrate would decide it on merits;\n<\/p>\n
[g]\tdespite
\nthis order, it would be open for the Investigating Agency to apply to
\nthe competent Magistrate, for police remand of the applicant. The
\napplicant shall remain present before the learned Magistrate on the
\nfirst date of hearing of such application and on all subsequent
\noccasions, as may be directed by the learned Magistrate. This would
\nbe sufficient to treat the accused in the judicial custody for the
\npurpose of entertaining application of the prosecution for police
\nremand. This is, however, without prejudice to the right of the
\naccused to seek stay against an order of remand, if ultimately
\ngranted, and the power of the learned Magistrate to consider such a
\nrequest in accordance with law. It is clarified that the applicant,
\neven if, remanded to the police custody, upon completion of such
\nperiod of police remand, shall be set free immediately, subject to
\nother conditions of this anticipatory bail order.\n<\/p>\n
At
\n\tthe trial, the trial court shall not be influenced by the prima
\n\tfacie observations made by this Court while enlarging the applicant
\n\ton bail.\n<\/p>\n
\tRule
\nmade absolute. Application is disposed of accordingly.\n<\/p>\n
\tDirect
\nservice is permitted.\n<\/p>\n
