DEVANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/01\/2010 \n\n \n\n \n \n ORAL\nJUDGMENT<\/pre>\n<p> :-\n<\/p>\n<p>1.\tThe present<br \/>\nappeal arises out of a judgment and order rendered by Sessions Court,<br \/>\nNavsari, in Sessions Case No.29 of 2005, convicting the appellant for<br \/>\nthe offences punishable under Sections 376 and 506(2) of the Indian<br \/>\nPenal Code and Sections 3(1)(10) and 12 of the Scheduled Castes and<br \/>\nScheduled Tribes (Prevention of Atrocities) Act, 1989.  The appellant<br \/>\nis sentenced to undergo imprisonment for life in the said offences<br \/>\nand to pay a fine of Rs.1,50,000\/- and, in default, to undergo<br \/>\nrigorous imprisonment for a further period of six months.  The Trial<br \/>\nCourt ordered that, if the appellant paid the fine, Rs.75,000\/- will<br \/>\nbe paid to the prosecutrix and the daughter conceived by her through<br \/>\nthe coitus with the appellant.\n<\/p>\n<p>2.\tOn the last<br \/>\noccasion, when the matter was heard on 12th January, 2010,<br \/>\nlearned Advocate for the appellant stated that he was instructed by<br \/>\nhis client, the appellant, to request the Court to permit the<br \/>\nappellant a personal audience.  This Court, therefore, directed the<br \/>\njail authorities to keep the appellant present before us today and,<br \/>\naccordingly, the appellant is before us.\n<\/p>\n<p>3.\tThe<br \/>\nappellant has indicated to us directly and the learned Advocate, upon<br \/>\ninstructions, states that the appellant does not want to challenge<br \/>\nthe conviction.  The prayer is only to reduce the substantive<br \/>\nsentence and in lieu thereof, enhance the fine and grant more<br \/>\ncompensation to the victims, namely, the prosecutrix and her daughter<br \/>\nbegotten through the incident.  The appellant has indicated that he<br \/>\nis married and he has a wife and three minor children to support.  He<br \/>\nalso indicated that the prosecutrix is now married somewhere else and<br \/>\nis settled in her matrimonial home. Though meekly, it was submitted<br \/>\nthat it was a case of a love affair and the appellant is engaged in<br \/>\nplying rickshaw and agricultural work.\n<\/p>\n<p>4.\tWe have<br \/>\nheard learned Additional Public Prosecutor, Mr. Nanavati,  on the<br \/>\nquestion of sentence.\n<\/p>\n<p>5.\tThe<br \/>\nappellant is in jail since the date of his arrest, ie. about four<br \/>\nyears and seven months.  The law prescribes minimum imprisonment for<br \/>\na period of seven years for the offence for which the appellant is<br \/>\nconvicted.  What is awarded by the Trial Court is the maximum<br \/>\npunishment.  The case, in our view, does not fall within the category<br \/>\nof such an exceptionally grave case where maximum punishment would be<br \/>\njustified nor is the case such where the minimum prescribed can be<br \/>\nawarded.  The appellant was 33 years old at the time of the incident<br \/>\nand was married.  The prosecutrix was aged only 13 years at the time<br \/>\nof the incident.  Under the circumstances, in our view, a balance<br \/>\nwould be struck if the substantive sentence is reduced to rigorous<br \/>\nimprisonment for a period of 10 years with enhancement  of fine from<br \/>\nRs.1,50,000\/- to Rs.3,00,000\/-.\n<\/p>\n<p>6.\tWe have<br \/>\ndispensed with the procedure of issuing notice for enhancement of<br \/>\nfine in view of the fact that the appellant himself has volunteered<br \/>\nto pay more fine, leaving the quantum of enhancement to the<br \/>\ndiscretion of the Court.\n<\/p>\n<p>7.\tThe appeal,<br \/>\ntherefore, would stand partly allowed.  The conviction of the<br \/>\nappellant is confirmed.  The appellant is sentenced to undergo<br \/>\nrigorous imprisonment for a period of ten years with a fine of<br \/>\nRs.3,00,000\/- (Rupees three lakhs).  In default of payment of fine,<br \/>\nthe appellant shall undergo further imprisonment for a period of four<br \/>\nyears.\n<\/p>\n<p>7.1\tIf the<br \/>\nappellant deposits the amount of fine, an amount of Rs.1,50,000\/-<br \/>\nshall go to the daughter begotten by the prosecutrix through the<br \/>\nincident.  We are informed that the daughter is with the mother.  The<br \/>\namount going to the share of the daughter shall be invested through<br \/>\nthe mother as mother and natural guardian in a nationalized bank for<br \/>\nthe period till the minor attains the age of 21 years.  The<br \/>\nprosecutrix would, however, be entitled to withdraw periodical<br \/>\ninterest that may accrue on that amount.  The fixed deposit receipts<br \/>\nwill be retained by the Nazir of the Sessions Court till the minor<br \/>\nattains the age of 21 years.\n<\/p>\n<p>7.1.1\t  Out of<br \/>\nthe fine deposited, an amount of Rs.1,00,000\/- (one lakh) shall be<br \/>\npaid by way of compensation to the prosecutrix by a crossed account<br \/>\npayee cheque to be deposited in a nationalized bank by way of fixed<br \/>\ndeposit for a period of five years.  She would, however, be entitled<br \/>\nto draw periodical interest that may accrue thereon.\n<\/p>\n<p>7.2\tThe<br \/>\nappellant-convict may be sent back to Central Prison, Vadodara.<br \/>\nOrder accordingly.\n<\/p>\n<p>\t\t\t\t\t\t[  A.\n<\/p>\n<p>L.
