JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/09\/2011  \nORAL ORDER<\/pre>\n<p>\tHeard<br \/>\nMr.Mehul H. Rathod, learned counsel for the petitioners. It is<br \/>\nsubmitted by him that the impugned order dated 16.11.2010 has not<br \/>\nbeen passed in consonance with the provisions of Section 53(A) of the<br \/>\nBombay Stamp Act, 1958, inasmuch as before exercising power under the<br \/>\nsaid provisions of law, the Controlling Authority must come to a<br \/>\nconclusion that the order of the Deputy Collector is erroneous and,<br \/>\nfurther, the material on record, upon which the determination of the<br \/>\nstamp duty has been done, should be supplied to the petitioners. It<br \/>\nis submitted that in the present case, no documents have been<br \/>\nsupplied, even though in the reply to the notice, the petitioners<br \/>\nhave specifically raised this point.\n<\/p>\n<p>\tThe<br \/>\nlearned counsel for the petitioners has further submitted that the<br \/>\nnotice dated 11.08.2008 has been issued after determining the market<br \/>\nvalue, however, how and on what basis the market value has been<br \/>\ndetermined, has not been disclosed. It is contended that the<br \/>\nCalculation-sheet supplied to the petitioners reveals that the market<br \/>\nvalue has been fixed on the Jantri rates for commercial property, as<br \/>\nprevailing in the year 1999. However, the Jantri can only be one of<br \/>\nthe relevant documents, but the market value must be determined by<br \/>\nconsidering other relevant material and factors as well, which has<br \/>\nnot been done in the present case.\n<\/p>\n<p>\tIt<br \/>\nis further submitted that the property in question is an open,<br \/>\nnon-agricultural land that is being used for breeding of horses by<br \/>\nthe petitioners, which is not a commercial activity.\n<\/p>\n<p>\tIn<br \/>\nsupport of the above submissions, the learned advocate for the<br \/>\npetitioners has placed reliance upon a judgment of this Court in<br \/>\nNandadevi<br \/>\nDineshkumar Sharma Vs.
