Sivadas, counsel for the petitioner<\/p>\n<p>and Advocate M.A. Manhu for the respondents.<\/p>\n<p>      2.   This   Court   had   occasion   to   consider   similar<\/p>\n<p>grievances in writ petitions filed by the former employees<\/p>\n<p>of the respondents.  Those cases were disposed of directing<\/p>\n<p>the   respondents   to   pay   the   amount   legitimately   due   to   the<\/p>\n<p>retired   employees,   within   a   time   limit.     Learned   counsel<\/p>\n<p>for the respondents submits that the delay is on account of<\/p>\n<p>the financial crunch suffered by the Corporation.<\/p>\n<p>      2.   Heard   both   sides.     The   retired   employees   shall   be<\/p>\n<p>paid   all   amounts   legitimately   due   to   them   within   a<\/p>\n<p>reasonable   time   even   if   the   submission   made   on   behalf   of<\/p>\n<p>the   respondents   that   the   Corporation   is   going   through   a<\/p>\n<p>period   of   financial   stringency   is   the   true   state   of<\/p>\n<p>affairs.     The   writ   petition   is   therefore   disposed   of<\/p>\n<p>directing the respondents to pay the petitioner the amounts<\/p>\n<p>legitimately   due   to   him   towards   gratuity,   leave   surrender<\/p>\n<p>salary, pay revision arrears, D.A. arrears and other dues,<\/p>\n<p><span class=\"hidden_text\">WPC No.27461\/06                      -2-<\/span><\/p>\n<p>if   any,   within   four   months   from   the   date   of   receipt   of   a<\/p>\n<p>copy   of   this   judgment.     The   petitioner   may   produce   a   copy<\/p>\n<p>of the judgment before the respondents for due compliance.<\/p>\n<p>      3.   The   petitioner   has   prayed   for   interest   for   the<\/p>\n<p>delayed payment.   I do not think that this is a case where<\/p>\n<p>the respondents can be directed to pay interest in exercise<\/p>\n<p>of the discretionary jurisdiction under Article 226 of the<\/p>\n<p>Constitution   of   India   since   the   delay   in   disbursing   the<\/p>\n<p>amount   is   not   due   to   any   deliberate   inaction   or   culpable<\/p>\n<p>lethargy   on   the   part   of   the   respondents,   but   only   on<\/p>\n<p>account of financial stringency and for reasons beyond the<\/p>\n<p>control   of   the   respondents.     Hence,   that   prayer   is<\/p>\n<p>declined.\n<\/p>\n<\/p>\n<p>      The writ petition is disposed of as above.<\/p>\n<p>                                                         K.K.
