DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\napplication is filed under Section 438 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.I-456 of 2010 with J.P. Road Police Station, Vadodara, for the<br \/>\noffences punishable under Sections 498-A, 323, 328, 504 and 114 of<br \/>\nthe Indian Penal Code.\n<\/p>\n<p>2.\tLearned<br \/>\ncounsel for the applicants submit that the applicants are<br \/>\nsister-in-law and brother-in-law and residing at Ahmedabad.  The<br \/>\ncomplainant is residing at her matrimonial home and Ahmedabad and<br \/>\nallegations are to the extent that the applicant No.1 used to<br \/>\ntelephone her brother and instigate him to divorce the complainant.<br \/>\nIt is therefore submitted that when other co-accused including<br \/>\nfather-in-law mother-in-law and even husband are enlarged on bail,<br \/>\nthe case of the applicants be considered for anticipatory bail.\n<\/p>\n<p>3.\tHeard<br \/>\nLearned APP for the respondent &#8211; State.\n<\/p>\n<p>4.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the above facts, I am inclined to<br \/>\ngrant anticipatory bail to the applicants.  This Court has also taken<br \/>\ninto consideration the law laid down by the Apex Court in the case of<br \/>\n<a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra &amp; Ors.<br \/>\nReported<\/a> in [2011]1 SCC 694, wherein the Apex Court<br \/>\nreiterated the law laid down by the Constitutional Bench in the case<br \/>\nof Shri Gurubaksh Singh Sibbia &amp; Ors. Reported in [1980]2<br \/>\nSCC 565.\n<\/p>\n<p>5.\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>6.\tIn<br \/>\nthe result, this application is allowed by directing that in the<br \/>\nevent of the applicants herein being arrested pursuant to FIR being<br \/>\nCR No.I-456 of 2010 with J.P. Road Police Station, Vadodara,  the<br \/>\napplicants shall be released on bail on furnishing a bond of<br \/>\nRs.10,000\/- (Rupees Ten Thousand only) each with one surety of like<br \/>\namount on following conditions :-\n<\/p>\n<p>[a]\tshall<br \/>\ncooperate with the investigation and make themselves available for<br \/>\ninterrogation whenever required.\n<\/p>\n<p>[b]\tshall<br \/>\nremain present at concerned Police Station on  26.2.2011 between<br \/>\n11:00 am to 2:00 pm:\n<\/p>\n<p>[c]\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>[d]\tshall<br \/>\nat the time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e]<br \/>\n\twill not leave India without the permission of the Court and, if is<br \/>\nholding a Passport, shall surrender the same before the trial Court<br \/>\nimmediately<\/p>\n<p>[f]\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>[g]\tdespite<br \/>\nthis order, it would be open for the Investigating Agency to apply to<br \/>\nthe competent Magistrate, for police remand of the applicant. The<br \/>\napplicants shall remain present before the learned Magistrate on the<br \/>\nfirst date of hearing of such application and on all subsequent<br \/>\noccasions, as may be directed by the learned Magistrate. This would<br \/>\nbe sufficient to treat the accused in the judicial custody for the<br \/>\npurpose of entertaining application of the prosecution for police<br \/>\nremand. This is, however, without prejudice to the right of the<br \/>\naccused to seek stay against an order of remand, if ultimately<br \/>\ngranted, and the power of the learned Magistrate to consider such a<br \/>\nrequest in accordance with law. It is clarified that the applicant,<br \/>\neven if, remanded to the police custody, upon completion of such<br \/>\nperiod of police remand, shall be set free immediately, subject to<br \/>\nother conditions of this anticipatory bail order.\n<\/p>\n<p>7.\tRule<br \/>\nmade absolute.
