1.Assailing the judgment of the learned single<\/p>\n
 Judge in W.P.(C).915 of 2007 dated 24.6.2009,<\/p>\n
 these   appeals  were  filed   by  both   parties.<\/p>\n
 W.A.No.2893  of   2009  was  filed  by  the   writ<\/p>\n
 petitioner.   The other appeal was preferred by<\/p>\n
 the respondents.    Hereinafter the parties are<\/p>\n
 referred   as  they  are   arrayed  in  the   writ<\/p>\n
 petition.   The writ petitioner died pending the<\/p>\n
 appeals.   His legal heirs were impleaded as per<\/p>\n
 the order in I.A.No.53 of 2010 in W.A.No.2893 of<\/p>\n
 2009.    The writ petitioner was a High School<\/p>\n
 Teacher in S.N.Vilasam High School, Aloor.   While<\/p>\n
 so, on 2.5.1996 he was promoted as Headmaster.<\/p>\n
 He   would  complete  20   years  of  service   on<\/p>\n
 31.5.1996 and would have been entitled to a<\/p>\n
 higher   grade  had  he   not  been  promoted   as<\/p>\n

 Headmaster.       His   regular  increment,  but for<\/p>\n
 promotion, would have fallen due on 1.7.1996.<\/p>\n
 Hoping for consequential benefit, he preferred an<\/p>\n
 option for fixation of his pay in the cadre of<\/p>\n
 Headmaster with effect from 1.7.1996.       If it is<\/p>\n
 allowable, he would be entitled to a grade on<\/p>\n
 1.6.1996 with fixation and then a re-fixation in<\/p>\n
 pursuance     of   the   regular  increment  due  on<\/p>\n
 1.7.1996.     If fixation in the post of Headmaster<\/p>\n
 is done thereafter, he would get another jumping<\/p>\n
 of the salary.         It is with this in mind he<\/p>\n
 preferred to opt for Headmaster’s salary after<\/p>\n
 1.7.1996.       Without considering the legality of<\/p>\n
 the option, his pay was fixed by the authorities<\/p>\n
 as opted by him.       Audit party objected the same.<\/p>\n
 Though he did not get a copy of the audit<\/p>\n
 objection, against oral information, he preferred<\/p>\n
 Exts.P1 and P2 objections assailing the audit<\/p>\n
 objection.     In the eve of retirement, according<\/p>\n
 to    the   petitioner,    without  considering  the<\/p>\n

 objection filed, steps were ahead to sustain the<\/p>\n
 audit    objection.        The  District   Educational<\/p>\n
 Officer communicated audit objection to the writ<\/p>\n
 petitioner through Ext.P3.       Writ petitioner filed<\/p>\n
 Ext.P4 objection stating that he is entitled to a<\/p>\n
 re-option     as    per    G.O.(P)No.615\/(138)\/97\/Fin.<\/p>\n
 dated 28.6.1997, copy of which was produced as<\/p>\n
 Ext.P6.     While so, the petitioner retired from<\/p>\n
 service on 31.3.2002.         Rejecting the objection<\/p>\n
 raised by the petitioner, his salary was reduced<\/p>\n
 to    Rs.7,950\/-    from    Rs.8,550\/-.     Consequent<\/p>\n
 reductions were made in the pension as well as in<\/p>\n
 the D.C.R.G.       Writ petitioner moved this Court<\/p>\n
 with    W.P.(C)No.35556     of  2005.     This  Court<\/p>\n
 directed     the    respondents    to   consider  the<\/p>\n
 objection filed by the petitioner.        The D.E.O.,<\/p>\n
 in the light of the direction given by this<\/p>\n
 Court, examined the matter and by Ext.P8 order<\/p>\n
 dated 21.4.2006 found that earlier the salary of<\/p>\n
 the petitioner was correctly fixed in accordance<\/p>\n
W.A.Nos.2893\/09 & 704\/10.\n<\/p>\n
                          -: 4 :-<\/span><\/p>\n
 with the re-option exercised by him as per G.O.<\/p>\n
 (P)No.615\/(138)\/97\/Fin.          Dated      28.6.1997.<\/p>\n
 However, the D.E.O. forwarded Ext.P8 order to the<\/p>\n
 Government for approval.          The Government, by<\/p>\n
 Ext.P10 dated 31.8.2006, rejected the objection<\/p>\n
 raised by the petitioner.       Following Ext.P10, the<\/p>\n
 Deputy Director,        by Ext.P9 dated 21.9.2006,<\/p>\n
 issued an order rejecting the objection raised by<\/p>\n
 the petitioner.       Assailing Exts.P3, P9 and P10<\/p>\n
 this writ petition was moved.          By an interim<\/p>\n
 order, again this Court issued a direction to re-<\/p>\n
 consider the objection raised by the petitioner.<\/p>\n
 In pursuance of that direction, the Government<\/p>\n
 again considered the matter and issued Exts.P11<\/p>\n
 and P12 orders again rejecting the objection<\/p>\n
 raised by the writ petitioner.       Thereafter, writ<\/p>\n
 petition was amended to assail Exts.P11 and P12<\/p>\n
 also.\n<\/p>\n<\/p>\n
2.The learned single Judge by the impugned judgment<\/p>\n
W.A.Nos.2893\/09 & 704\/10.\n<\/p>\n
                          -: 5 :-<\/span><\/p>\n
 arrived at a finding that the claim made by the<\/p>\n
 writ petitioner as well as the objection raised<\/p>\n
 by the respondents are not sustainable.        It was<\/p>\n
 further found that the writ petitioner, who was a<\/p>\n
 P.D. Teacher, is entitled to a higher grade on<\/p>\n
 completion of 20 years of service by 31.5.1996<\/p>\n
 and he is entitled to a re-option with effect<\/p>\n
 from    1.6.1996.        The    request  to   opt   to<\/p>\n
 Headmaster’s pay with effect from 1.7.1996 was<\/p>\n
 turned down and the writ petition was disposed of<\/p>\n
 directing the writ petitioner to file a formal<\/p>\n
 option for the purpose of clause (c) of sub-<\/p>\n
 clause (ii) of Ext.P14 order with date of option<\/p>\n
 as    1.6.1996    and   further    ordered  that   the<\/p>\n
 petitioner’s     pay   should   be  fixed  within  two<\/p>\n
 months in accordance with that option.       Now these<\/p>\n
 appeals.\n<\/p>\n<\/p>\n
3.We heard Government Pleader as well as counsel<\/p>\n
 for the writ petitioner.        The fact that the writ<\/p>\n

                          -: 6 :-<\/span><\/p>\n
 petitioner     was    a  graduate    teacher  is   not<\/p>\n
 disputed.     However, it was mistakenly mentioned<\/p>\n
 in the impugned judgment that he was a P.D.<\/p>\n
 Teacher.     Hence we record that the petitioner is<\/p>\n
 a graduate teacher.        Going by Exts.P13 and P14<\/p>\n
 Government     Orders,   we  find   that  whether  the<\/p>\n
 petitioner is a graduate teacher or a P.D.Teacher<\/p>\n
 makes no difference as regards the claim advanced<\/p>\n
 by the writ petitioner.          On his promotion as<\/p>\n
 Headmaster on 2.5.1996, he is entitled to get his<\/p>\n
 salary     fixed    in   the    scale  applicable   to<\/p>\n
 Headmasters.     Exts.P13 and P14 Government Orders<\/p>\n
 entitle a graduate teacher to get a higher grade<\/p>\n
 on    completion      of   20    years   of   service,<\/p>\n
 irrespective     of    promotion   as  Headmaster   on<\/p>\n
 2.5.1996.      Therefore, in the light of Exts.P13<\/p>\n
 and P14 Government Orders, without an option, the<\/p>\n
 writ petitioner is entitled to a re-fixation on<\/p>\n
 1.6.1996 when he completed 20 years service as a<\/p>\n
 graduate teacher.       That position is not at all<\/p>\n

                          -: 7 :-<\/span><\/p>\n
 disputed by the respondents.       The learned counsel<\/p>\n
 for    the   writ   petitioner   submitted  that   the<\/p>\n
 petitioner      would    be     satisfied   by    that<\/p>\n
 declaration.\n<\/p>\n<\/p>\n
4.Though the writ petitioner has got a contention<\/p>\n
 that he is entitled to file an option in the<\/p>\n
 light of Ext.P5 order to switch over to the scale<\/p>\n
 of Headmasters at a later stage, we fail to find<\/p>\n
 that there is any such right of option.       The writ<\/p>\n
 petitioner, having been promoted on 2.5.1996, is<\/p>\n
 bound to get his salary as Headmaster fixed from<\/p>\n
 that date onwards.      The right of option to change<\/p>\n
 over to the scale of pay arises only in respect<\/p>\n
 of the existing scale of pay in the existing<\/p>\n
 cadre as on the date of the pay revision order.<\/p>\n
 Once pay revision implementing orders are issued,<\/p>\n
 the subsequent promotees and appointees are bound<\/p>\n
 by the scale of pay fixed for the post concerned.<\/p>\n
 That    being   so,   we  find   that  the  permission<\/p>\n

                          -: 8 :-<\/span><\/p>\n
 granted to the writ petitioner to file a re-<\/p>\n
 option to switch over to the Headmaster’s salary<\/p>\n
 with effect from 1.6.1996 is not sustainable.<\/p>\n
 Whereas,     as    mentioned     earlier,  the   writ<\/p>\n
 petitioner     is   entitled    to  higher grade   on<\/p>\n
 completion     of   20  years   service  as  graduate<\/p>\n
 teacher and for re-fixation of his pay in the<\/p>\n
 light of Exts.P13 and P14 Government Orders.      But<\/p>\n
 for Exts.P13 and P14, the writ petitioner is not<\/p>\n
 entitled to a re-fixation on 1.6.1996 because<\/p>\n
 grade is usually sanctioned in lieu of promotion<\/p>\n
 and the petitioner, having obtained promotion<\/p>\n
 before he being entitled to get a higher grade.<\/p>\n
 If the petitioner was not promoted on 2.5.1996,<\/p>\n
 he would have got his grade on 1.6.1996 and the<\/p>\n
 salary fixed in the higher grade and then he<\/p>\n
 would have been entitled to a re-fixation on<\/p>\n
 1.7.1996, on which day he is entitled to a<\/p>\n
 regular increment.      Here, in this case, since the<\/p>\n
 writ petitioner was promoted on 2.5.1996, he is<\/p>\n

                          -: 9 :-<\/span><\/p>\n
 entitled to have fixed his salary as Headmaster<\/p>\n
 on    the   existing    scale   as  on  the  date   of<\/p>\n
 promotion.      On 1.6.1996, he is entitled to a<\/p>\n
 higher grade in the light of Exts.P13 and P14 and<\/p>\n
 consequently he is entitled to have a fixation on<\/p>\n
 that date and his salary as Headmaster would be<\/p>\n
 re-fixed accordingly.       His next increment would<\/p>\n
 fall due only on 1.6.1997.       He is not entitled to<\/p>\n
 opt the commencement of salary as Headmaster<\/p>\n
 either on 1.6.1996 or on 1.7.1996.       The impugned<\/p>\n
 judgment requires such interference.<\/p>\n
5.We notice that, in State service, every incumbent<\/p>\n
 is   given    his   or  her    basic pay  fixed   with<\/p>\n
 reference to the date of his entry in service or<\/p>\n
 promotion.      Consequently, the annual increment,<\/p>\n
 grade, re-fixation of salary pursuant to pay<\/p>\n
 revision had to commence individually resulting<\/p>\n
 administrative workload in every office as well<\/p>\n
 as dispute thereon regarding the fixation of pay.<\/p>\n

                          -: 10 :-<\/span><\/p>\n
 Recently, the Government has unified the date of<\/p>\n
 retirement.        In   the   event,  commencement  of<\/p>\n
 service and promotion is unified to a particular<\/p>\n
 date in an year, irrespective of entry to service<\/p>\n
 or    promotion,    rather    than  giving  individual<\/p>\n
 dates, we find that much dispute and consequent<\/p>\n
 litigation     regarding     pay  fixation  could   be<\/p>\n
 avoided.     However, it is for the State to decide<\/p>\n
 and we direct the Government to consider the<\/p>\n
 proposal.      A copy of this judgment shall be<\/p>\n
 forwarded to the Secretary, Finance as well as<\/p>\n
 Secretary to the Pay Revision Commission for<\/p>\n
 considering the above proposal.\n<\/p>\n
    In the result, WA.No.704\/2010 is allowed.      The<\/p>\n
  impugned judgment permitting the petitioner to<\/p>\n
  opt to the salary of the Headmaster with effect<\/p>\n
  from 1.6.1996 is set aside.           It is further<\/p>\n
  declared that the salary of the petitioner as<\/p>\n
  Headmaster would be fixed as on 2.5.1996, the<\/p>\n
W.A.Nos.2893\/09 & 704\/10.\n<\/p>\n
                          -: 11 :-<\/span><\/p>\n
  date when he took charge as Headmaster.       In the<\/p>\n
  light of Exts.P13 and P14, he is entitled to a<\/p>\n
  grade with effect from 1.6.1996 and to get his<\/p>\n
  salary re-fixed with routine increments and other<\/p>\n
  benefits.    The other appeal would stand disposed<\/p>\n
  as above.\n<\/p>\n<\/p>\n
