Respondents\n\nPrayer\n\nWrit Petition filed under Article 226 of the Constitution of India, for\nissuance of a Writ of Mandamus, directing the first respondent to release the\nVan bearing Registration No.KL-20-4342, seized on 19.11.2009 by the second\nrespondent, to the petitioner.\n\n!For Petitioner\t\t... \tMr.T.Lenin Kumar\n^For Respondents\t...  \tMr.Pala Ramasamy\n\t\t \t\tSpecial Government Pleader\n\n * * * * *\n:ORDER\n<\/pre>\n<p>\tThis Writ Petition has been filed for the issuance of a Writ of Mandamus,<br \/>\nto direct the first respondent to release the Van bearing Registration No.KL-20-<br \/>\n4342, seized on 19.11.2009 by the second respondent, to the petitioner.\n<\/p>\n<p>\t2. \tHeard Mr.T.Lenin Kumar, the learned counsel appearing on behalf of<br \/>\nthe petitioner and Mr.Pala Ramasamy, learned Special Government Pleader,<br \/>\nappearing on behalf of the respondents.\n<\/p>\n<p>\t3. \tIn view of the averments made by the petitioner and taking into<br \/>\nconsideration the relief prayed for by the petitioner and since similar orders<br \/>\nhave been passed by this Court, the first respondent is directed to release the<br \/>\nVan bearing Registration No. KL-20-4342  to the petitioner, on his fulfilling<br \/>\nthe following conditions:-\n<\/p>\n<p>\t(i) The petitioner shall establish the ownership of the vehicle by<br \/>\nproducing the necessary documents and the certificates before the first<br \/>\nrespondent, including the R.C. book;\n<\/p>\n<p>\t(ii) The petitioner shall not alienate the vehicle, in any manner, till<br \/>\nthe adjudication proceedings are completed;\n<\/p>\n<p>\t(iii) The petitioner shall deposit a sum of Rs.10,000\/- (Rupees ten<br \/>\nthousand only), in cash, with the first respondent; and<\/p>\n<p>\t(iv) The petitioner shall give an undertaking before the first respondent<br \/>\nthat he shall not use the vehicle, for any illegal purpose, in future and he<br \/>\nshall also produce the vehicle, as and when it is required by the first<br \/>\nrespondent.\n<\/p>\n<p>\t4. \tWith the above directions, the Writ Petition is disposed of.
