SAHAI\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 11\/11\/2011 \nORAL ORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE KS JHAVERI)<\/p>\n<p>\t\tBy<br \/>\nway of this petition, the petitioner has challenged the order dated<br \/>\n02.11.2011 passed by the Election Officer &#8211; respondent No.3<br \/>\nherein and sought the direction to include the name of the petitioner<br \/>\nas a representative of the Manpura Vividh Karyakari Seva Sahakari<br \/>\nMandali Limited &#8211; respondent No.5 society for the election of<br \/>\nrespondent No.6 Society.\n<\/p>\n<p>2.\t\tThe<br \/>\nfacts of the case are that the petitioner moved an application on<br \/>\n11.10.2011 stating that the respondent No.2 is not the member of<br \/>\nrespondent No.5 Society and hence he cannot represent the respondent<br \/>\nNo.5 Society as he has produced forged document and become Chairman<br \/>\nof the Society.\n<\/p>\n<p>3.\t\tHowever,<br \/>\nwhile considering the case, the Election Officer has given reasons<br \/>\nthat the question as to whether the member of the Mandali is entitled<br \/>\nto be enrolled as member or can represent the Society can be taken by<br \/>\nthe District Registrar under Section 32 read with Section 28 (3) of<br \/>\nthe Gujarat Co-operative Societies Act, 1965.  We are in complete<br \/>\nagreement with the view taken by the Election Officer.  It will be<br \/>\nopen for the petitioner to move either the District Registrar or<br \/>\nBoard of Nominees seeking appropriate relief.\n<\/p>\n<p>4.\tWith<br \/>\nthe above observation, the petition stands dismissed in view of<br \/>\navailability of alternative remedy to the petitioner either before<br \/>\nthe District Registrar of Board of Nominees.
