Justice KURIAN JOSEPH\n\n Dated :18\/07\/2008\n\n O R D E R\n                          KURIAN JOSEPH, J.\n                ----------------------------------------------\n                     W.P.(C) No.2854 of 2004\n                ----------------------------------------------\n                       Dated 18th July, 2008.\n                            J U D G M E N T\n<\/pre>\n<p>                  The writ petition is filed mainly with the following<\/p>\n<p>prayers :-\n<\/p>\n<blockquote><p>           (i)    &#8220;Issue a writ of mandamus or any other appropriate writ,<br \/>\n           order or direction, directing the respondents 3 and 4 to consider<br \/>\n           and dispose of Ext.P6.\n<\/p><\/blockquote>\n<blockquote><p>           (ii)   issue a writ of mandamus or any other appropriate writ,<br \/>\n           order or direction, directing the respondents 1 to 4 to consider<br \/>\n           and dispose of Ext.P7.\n<\/p><\/blockquote>\n<blockquote><p>           (iii)  issue a writ of mandamus or any other appropriate writ,<br \/>\n           order or direction directing the 5th respondent to consider and<br \/>\n           dispose of Ext.P8.&#8221;\n<\/p><\/blockquote>\n<p>The prayer is essentially for compensation as per the accident<\/p>\n<p>insurance policy. The stand taken on the counter affidavit filed by<\/p>\n<p>the third respondent is that the death of the petitioner&#8217;s husband<\/p>\n<p>is natural death and it is not covered by the Insurance policy. In<\/p>\n<p>view of the disputed facts, the remedy open to the petitioner is to<\/p>\n<p>approach the civil court.
