Goyal, and<br \/>\n                Mr. Sandeep Goyal, Advocates, for the respondent.\n<\/p>\n<p>Rajesh Bindal J.\n<\/p>\n<p>                The revenue has filed the present appeal under Section 35G of<br \/>\nthe Central Excise Act, 1944, against the order passed by the Customs,<br \/>\nExcise &amp; Service Tax Appellate Tribunal, New Delhi, dated 26.4.2006,<br \/>\nraising the following substantial questions of law :-\n<\/p>\n<blockquote><p>                     i)      Whether CESTAT was correct in not going into the<br \/>\n                             merits of the case regarding the dutibility of the<br \/>\n                             product, when the remand order by the Hon&#8217;ble<br \/>\n                             Supreme Court and subsequently order by the larger<br \/>\n                             bench      of    the   CESTAT     specifically   contained<br \/>\n                             directions for deciding the dutiability of the product ?\n<\/p><\/blockquote>\n<blockquote><p>                     ii)     Whether CESTAT was justified in deciding the case<br \/>\n                             on a new ground i.e. limitation, when the remand<br \/>\n                             order by the Hon&#8217;ble Supreme Court is specific that<br \/>\n                             both the parties were at the liberty to produce<br \/>\n                             additional evidence only ?\n<\/p><\/blockquote>\n<blockquote><p>                     iii)    Whether the extended period of limitation is<br \/>\n                             invokable in cases where incomplete information is<br \/>\n                             supplied by a person other than the manufacturer of<br \/>\n                             the goods particularly in the event when the<br \/>\n                             information supplied by that person is vague,<br \/>\n                             incorrect and misleading ?&#8221;<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> Central Excise Appeal No. 178 of 2006                                 2<\/span><\/p>\n<p>                An identical issue came up for consideration before this court<br \/>\nin Central Excise Appeal No. 125 of 2006 titled as <a href=\"\/doc\/625658\/\">Commr. Of C. Ex.,<br \/>\nLudhiana vs Avon Cycles Ltd.,<\/a> which was dismissed vide order dated<br \/>\n20.11.2006.
