No.8980 of 2011\n                               BIRENDRA YADAV\n                                    Versus\n                             THE STATE OF BIHAR\n                                 -----------\n<\/pre>\n<p>2   28.03.2011             Heard learned counsel for the petitioner<\/p>\n<p>                 as well as learned Additional Public Prosecutor<\/p>\n<p>                 for the State.\n<\/p>\n<p>                           Admittedly, Tekari P.S. Case No.195 of<\/p>\n<p>                 2010     was     registered          under     bailable     section<\/p>\n<p>                 except    section       27    of     the    Arms   Act   which   was<\/p>\n<p>                 applicable against co-accused Ramjanam Yadav. It<\/p>\n<p>                 is     pointed    out    by        learned     counsel     for   the<\/p>\n<p>                 petitioner        that       after         investigation     police<\/p>\n<p>                 submitted      charge        sheet    under     Section    307   and<\/p>\n<p>                 other minor sections of the I.P.C. as well as 27<\/p>\n<p>                 of the Arms Act. It is further pointed out by<\/p>\n<p>                 him that there is allegation of giving Bhala<\/p>\n<p>                 blow to informant against the petitioner, but as<\/p>\n<p>                 a matter of fact no such injury has been found<\/p>\n<p>                 by the doctor in course of examination of the<\/p>\n<p>                 injured of this case, and moreover, there is<\/p>\n<p>                 case and counter case between the parties.<\/p>\n<p>                           From     perusal           of     impugned     order    of<\/p>\n<p>                 learned First Additional Sessions Judge, Gaya,<\/p>\n<p>                 it appears that injured has received two injuries<\/p>\n<p>                 on his chest and the learned Additional Sessions<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>     Judge has observed that the aforesaid injuries<\/p>\n<p>     were dangerous to life, but Annexure-3 of this<\/p>\n<p>     petition reveals that at para-31 of the case<\/p>\n<p>     diary    the    nature           of    injury    has    not    been<\/p>\n<p>     mentioned.\n<\/p>\n<p>               Moreover,         it    has    not    been    stated    by<\/p>\n<p>     learned Additional Sessions Judge, Gaya as to<\/p>\n<p>     under which circumstances the aforesaid injuries<\/p>\n<p>     became dangerous to the life of the informant.<\/p>\n<p>               Taking         into     consideration        the     above<\/p>\n<p>     stated    submissions             as    well    as     facts     and<\/p>\n<p>     circumstances of the case, let the petitioner,<\/p>\n<p>     namely, Birendra Yadav be released on bail on<\/p>\n<p>     furnishing       bail        bonds       of     Rs.10,000\/-(Ten<\/p>\n<p>     Thousand) with two sureties of the like amount<\/p>\n<p>     each,    to    the       satisfaction      of   Chief    Judicial<\/p>\n<p>     Magistrate, Gaya in connection with Tekari P.S.<\/p>\n<p>     Case No.195 of 2010.\n<\/p>\n<\/p>\n<p>                              (Hemant Kumar Srivastava, J.)<br \/>\nPN\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Birendra Yadav vs The State Of Bihar on 28 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
