Trivedi Commission of Inquiry, which is inquiring into the facts<br \/>\nand circumstances, leading to the death of two school boys in Asharam<br \/>\nAshram, situated in the outskirts of city of Ahmedabad.\n<\/p>\n<p>2.\t\tPetitioner has<br \/>\nchallenged the orders dated 20.09.2010 and 21.09.2010, passed by the<br \/>\nHon&#8217;ble Chairman of the Inquiry Commission, by which his application<br \/>\nExhibit Nos. 1962, 2031, 2038 and 2039 were rejected.\n<\/p>\n<p>3.\t\tThe case of the<br \/>\npetitioner is that he has carried out a sting operation against some<br \/>\nof the persons, who according to the petitioner, have been carrying<br \/>\non a triad against Asharam Bapu to malign and defame him. He fears<br \/>\nfor his safety, at the hands of some of these persons.  It is his<br \/>\ncase that he was also attacked, previously, for which he has filed a<br \/>\ncomplaint before the police.  He, therefore, requested to the<br \/>\nCommission that his evidence be recorded at Delhi, through a<br \/>\nCommissioner and he objected to six persons, to whom the<br \/>\ncommunication was made by the Commission for remaining present,<br \/>\nduring further recording of evidence of the petitioner. Essentially,<br \/>\nthese requests came to be turned down by the impugned orders.\n<\/p>\n<p>4.\t\tCounsel for the<br \/>\npetitioner drew my attention to various averments made in the<br \/>\npetition as well as emerging from the documents on record, to contend<br \/>\nthat there is a serious threat to the safety of the petitioner, on<br \/>\naccount of his activities, particularly, by carrying on sting<br \/>\noperation against the above-mentioned persons and others, of the said<br \/>\ngroup. He drew my attention to the observations of the Hon&#8217;ble<br \/>\nCommissioner in the order dated 27.06.2010, which read as follows:\n<\/p>\n<p>&#8221;  In view of the<br \/>\ndirections given earlier, Registry, vide letter dated 22.06.2010, had<br \/>\ninformed six persons viz. M\/s. Raju Chandak, Amrut Prajapati(Vaidya),<br \/>\nMahendra Chawala, Shekar Girdharilal, Ms. Veena Chauhan and Ms.<br \/>\nFalguni Patel (Editor-Sandesh) that, the witness MR. Rathore is being<br \/>\nexamined on behalf of Sant Shri Asaramji Ashram and his evidence has<br \/>\nremained partially recorded on 18.06.2010 and that further evidence<br \/>\nis to be recorded on 27.06.2010 and if so desire, they may remain<br \/>\npresent either personally or through authorized representative and<br \/>\nmay clarify the averments concerning them.  Accordingly, M\/s. Mahdera<br \/>\nChawala, Surendra Chauhan (GM, Admn.-Sandesh) and Ms. Veena Chauhan<br \/>\nremained present and this order is passed in their presence.&#8221;\n<\/p>\n<p>5.\t\tInsofar as the<br \/>\nconcern of the petitioner for his safety is concerned, in order to<br \/>\nensure that no untoward incident takes place, without going into the<br \/>\nallegations made in the petition, the State authorities are DIRECTED<br \/>\nto provide POLICE PROTECTION to the petitioner, while<br \/>\nhe is in AHMEDABAD for giving his EVIDENCE<br \/>\nbefore the Commission,  if he or his authorized agent MAKES<br \/>\na formal APPLICATION, in this regard, before the<br \/>\nCommissioner of Police, Ahmedabad.\n<\/p>\n<p>6.\t\tWith respect to the<br \/>\nobservations of the Commission noted in the order dated 27.06.2010, I<br \/>\ndo not see how the petitioner is harmed or prejudiced by mere<br \/>\npresence of the six persons to whom an intimation of recording of<br \/>\nevidence of the petitioner has been sent by the Commission.\n<\/p>\n<p>7.\t\tThe<br \/>\nlearned Counsel for the petitioner, however, submitted that in the<br \/>\nsaid order the Commission has permitted those persons to<br \/>\ncross-examine the petitioner with respect to averments concerning<br \/>\nthem.
