RAMKUMAR, J.\n                 = = = = = = = = = = = = =\n                   Crl.M.C.No. 1135 of 2010\n                = = = = = = = = = = = = = =\n                 Date: 22nd day of June, 2010\n\n                               ORDER\n<\/pre>\n<p>      The   petitioner is the accused in Crime No.1086\/2009 of<\/p>\n<p>Pathanamthitta Police Station for an offence punishable under<\/p>\n<p>Section 294(b) of the IPC. The petitioner seeks to quash<\/p>\n<p>Annexure-I final report and the subsequent proceedings pending<\/p>\n<p>on the file of the J.F.C.M Court-I, Pathanamthitta. The above case<\/p>\n<p>involves summons trial.\n<\/p>\n<p>      2. It is too early for this Court, exercising jurisdiction under<\/p>\n<p>Section 482 Cr.P.C, to quash the complaint and subsequent<\/p>\n<p>proceedings and also consider whether the ingredients of the<\/p>\n<p>offences are made out in the prosecution records.                 The<\/p>\n<p>Magistrate can state the substance of accusation to the accused<\/p>\n<p>and record his plea under Section 251 Cr.P.C only if the substance<\/p>\n<p>of accusation contains the ingredients of the offence alleged.      In<\/p>\n<p>the light of the decision in <a href=\"\/doc\/1843034\/\">Kamala Rajaram v. State of Kerala<\/a><\/p>\n<p>(2005(3) KLT 617), it is open to the petitioner to raise the present<\/p>\n<p>contentions at the time when the learned Magistrate records his<\/p>\n<p>plea under Section 251 Cr.P.C.\n<\/p>\n<p>Crl. M.C. No. 1135 of 2010<br \/>\n<span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>       3.      The learned counsel for the petitioner prays for<\/p>\n<p>exemption from appearance while raising the above plea before<\/p>\n<p>the Magistrate.          I am inclined to permit the petitioner to be<\/p>\n<p>represented through his counsel. Accordingly, if the petitioner<\/p>\n<p>files a petition for exemption during the stage of 251 Cr.P.C, the<\/p>\n<p>learned Magistrate shall consider the contention of the petitioner<\/p>\n<p>while recording his plea without insisting on his personal<\/p>\n<p>appearance.
