(J)\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     On discovering  that there\t had been embezzlement worth<br \/>\ncrores\tof   rupees,  by   way\t of   misappropriation\t and<br \/>\nmisutilisation of  government funds  meant for\tpurchase  of<br \/>\nfood grains and other essential commodities by the employees<br \/>\nof  Jammu   &amp;  Kashmir\t Cooperative  Supply  and  Marketing<br \/>\nFederation     Ltd.\t (JAKFED     for     short),\t the<br \/>\nCommissioner\/Secretary\tto   the   Government,\t Agriculture<br \/>\nProduction Department  filed  a\t complaint  with  the  Crime<br \/>\nBranch of  the Police  in  1994.  FIR  40\/1994\tcame  to  be<br \/>\nregistered  on\t the  basis   thereof.\t Subsequently,\t the<br \/>\ncomplaint\/FIR was  transferred to the Vigilance Organisation<br \/>\nby the\tGovernment and\tthe Vigilance  Department registered<br \/>\nFIR No.\t 3\/95 on  its basis  for offences under Section 5(2)<br \/>\nPCA and\t some other  offences under  the RPC and took up the<br \/>\ninvestigation in  hand.\t During\t the  preliminary  stage  of<br \/>\ninvestigation by  the Vigilance\t Department, the respondents<br \/>\nFiled a\t writ petition in the High Court for quashing of FIR<br \/>\n3\/95 and  as interim relief sought the stay of investigation<br \/>\ninto the  criminal case.  Notice was  issued and the learned<br \/>\nsingle Judge  also passed  an ex-parte order staying further<br \/>\ninvestigation till  the &#8216;next  date&#8217;. The  State,  appellant<br \/>\nherein, filed  a counter  to the  writ petition\t as well  as<br \/>\nobjections to the stay petition.\n<\/p>\n<p>     On 12.7.95 the writ petition came up for hearing before<br \/>\nthe learned  single Judge.  Request for\t adjournment of\t the<br \/>\ncase was  made on  behalf of  learned counsel  for the\twrit<br \/>\npetitioners, which appears to have been opposed on behalf of<br \/>\nthe State.  The hearing\t of the writ petition was adjourned.<br \/>\nSince, the  earlier stay  order was  to last  till the &#8216;next<br \/>\ndate&#8217;, arguments  were, however,  heard on  the question  of<br \/>\nextension of  the stay order. The learned single Judge after<br \/>\ntaking into  account the  objections and arguments raised at<br \/>\nthe bar\t was pleased  to refuse extension and he vacated the<br \/>\nstay order  dated 27.5.95.  During the\tcourse of the order,<br \/>\nthe learned single Judge observed:\n<\/p>\n<blockquote><p>     &#8220;This is  a matter where an unusual<br \/>\n     relief  is\t being\tclaimed\t by  the<br \/>\n     petitioners for  staying  the  very<br \/>\n     investigation  in\t an  FIR   which<br \/>\n     involves  commission   Of\toffences<br \/>\n     under the\tPrevention of Corruption<br \/>\n     Act and the Penal Code. In my view,<br \/>\n     the extension  of\tthe  stay  order<br \/>\n     passed on\t26th May  1995, by which<br \/>\n     investigation process  in\tthe  FIR<br \/>\n     was ordered to be stayed, is likely<br \/>\n     to defeat\tthe ends  of justice and<br \/>\n     the purpose  for which  the FIR was<br \/>\n     lodged.\t The\t  process     of<br \/>\n     investigation   relating\tto   the<br \/>\n     commission\t of   serious\toffences<br \/>\n     cannot, in\t the ordinary  course be<br \/>\n     allowed to be stalled. It is always<br \/>\n     however, open  to\ta  party,  at  a<br \/>\n     stage after  the completion  of the<br \/>\n     investigation that\t he may approach<br \/>\n     a court  of competent  jurisdiction<br \/>\n     for an  appropriate relief,  if  he<br \/>\n     feels that\t he is\taggrieved in any<br \/>\n     manner  by\t  the  result\tof   the<br \/>\n     investigation.\n<\/p><\/blockquote>\n<blockquote><p>\t  It is because of the aforesaid<br \/>\n     reasons that,  evenwhile I\t propose<br \/>\n     to adjourn\t the case because of the<br \/>\n     request of Shri Mohd. Aslam Bhat, I<br \/>\n     am\t not   inclined\t to  extend  the<br \/>\n     further operation\tof  the\t interim<br \/>\n     directions of this court dated 26th<br \/>\n     May  1995.\t In  that  view\t of  the<br \/>\n     matter, therefore,\t I   direct that<br \/>\n     the  aforesaid  interim  directions<br \/>\n     shall stand vacated forthwith.&#8221;<\/p><\/blockquote>\n<p>     The writ  petitioners, respondents\t herein,  challenged<br \/>\nthe order  of the learned Single Judge dated 12.7.95 through<br \/>\na Letters  Patent Appeal. The Division Bench disposed of the<br \/>\nLPA and\t the learned single Judge was required to reconsider<br \/>\nthe order  dated 12.7.95 and till then the investigation was<br \/>\ndirected to  remain stayed.  In actual effect,therefore, the<br \/>\norder dated  12.7.95 was  set aside and the stay application<br \/>\nremanded for  fresh  consideration  by\tthe  learned  single<br \/>\nJudge. The operative part of the order reads:\n<\/p>\n<p>     &#8220;Considering    the    matter    in<br \/>\n     totality, we  are of  the view that<br \/>\n     this appeal  can be  disposed of at<br \/>\n     this  preliminary\t hearing   stage<br \/>\n     without notice  to the  respondents<br \/>\n     in view of the innocuousness of the<br \/>\n     order  proposed   to   be\t passed.\n<\/p>\n<p>     Noticing that  the stay order dated<br \/>\n     26.5.95 was  to hold valid till the<br \/>\n     matter was\t to be considered by the<br \/>\n     writ court\t on the\t next  date  and<br \/>\n     keeping in\t regard that  prayer for<br \/>\n     adjournment had  been made\t on  the<br \/>\n     personal grounds of learned counsel<br \/>\n     for the  petitioners,  we\tdeem  it<br \/>\n     appropriate to direct that the stay<br \/>\n     matter shall  be  reconsidered  and<br \/>\n     counsel for  the petitioners  heard<br \/>\n     and   appropriate\t orders\t  passed<br \/>\n     whereon.  Order\taccordingly  any<br \/>\n     till the matter is considered again<br \/>\n     by the  writ  court,  investigation<br \/>\n     against the  petitioners shall  not<br \/>\n     proceed in FIR No.3\/95.&#8221;\n<\/p>\n<p>     The State is aggrieved of this Order, hence this appeal<br \/>\nby special leave.\n<\/p>\n<p>      Apart from  the question\tthat it\t is rather  doubtful<br \/>\nwhether a  Letters patent  Appeal would lie against an order<br \/>\nvacating an ex-parte interim order of stay, we find that the<br \/>\nimpugned order\tof the\tDivision  Bench\t is  otherwise\talso<br \/>\nunsustainable.\tWe  say\t it  with  respect  to\tthe  learned<br \/>\nDivision Bench\tthat it was not a proper manner of disposing<br \/>\nof the\tLetters Patent Appeal. The Letters Patent Appeal has<br \/>\nbeen &#8220;allowed&#8221; at the preliminary stage, without issuance of<br \/>\nany notice  to the appellant and without  even admitting it.<br \/>\nIt could  not be  done. According to the Division Bench, the<br \/>\nissuance of  notice was not considered necessary &#8220;in view of<br \/>\nthe innocuousness  of the  order proposed  to be passed&#8221;. We<br \/>\ncannot agree  with the\tview of the High Court. The order of<br \/>\nthe Division Bench is not an &#8216;innocuous&#8217; order. The Division<br \/>\nBench has in actual effect set aside the order of the single<br \/>\nJudge\tdated\t 12.7.95   and\t remanded   the\t  case\t for<br \/>\nreconsideration, without  expressly saying  so. The Division<br \/>\nBench also  restored the  order dated 27.5.95 by staying the<br \/>\ninvestigation in  FIR 3\/95.  Such an order could not be made<br \/>\nby the\tDivision Bench\twith hearing  the  parties.  On\t the<br \/>\nplainest consideration\tof justice, in our opinion the Bench<br \/>\nwas obliged  to hear  the opposite  party i.e. the appellant<br \/>\nherein before  passing the  impugned order more so since the<br \/>\nimpugned order before the Division Bench had been made after<br \/>\nhearing the appellant, herein. We do not wish to express any<br \/>\nopinion on  the\t merits\t of  the  controversy  in  the\twrit<br \/>\npetition but  find that\t the order staying the investigation<br \/>\nby the\tDivision Bench\tin the\tmanner in  which it has been<br \/>\ndone is\t not  at  all  sustainable.  The  grievance  of\t the<br \/>\nappellant that\tit has\tbeen  seriously\t prejudiced  by\t the<br \/>\nimpugned order is well founded.\n<\/p>\n<p>     This appeal  accordingly succeeds\tand is\tallowed. The<br \/>\nimpugned order\tof the\tDivision Bench\tis set aside and the<br \/>\norder of the learned single Judge dated 12.7.95 is restored.<br \/>\nThe investigation shall be expedited.\n<\/p>\n<p>     The writ  petition shall  be decided on its own merits,<br \/>\nin accordance  with the\t settled law  on the  subject, after<br \/>\nhearing the parties, expeditiously.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of Jammu &amp; Kashmir vs Sham Lal &amp; Ors on 10 May, 1996 Author: A Anand Bench: Anand, A.S.
