Respondent\n\nPrayer\n\nThis petition has been filed under Article 226 of the Constitution of\nIndia, praying for the issuance of a Writ of Mandamus, directing the respondent\nto hand over the title documents relating to i) S.No.307, D.No.2, Katha Pillai\nStreet, Main Road, Melur Taluk, Madurai District, ii) S.No.243\/2C1A, D.No.17A,\nKasukara Chetty Street, Thattan Karuppan Koil Street, Melur Taluk, Madurai\nDistrict and iii) S.No.243\/2C1A, D.No.17A, Kasukara Chetty Street, Thattan\nKaruppan Koil Street, Melur to the petitioner which were deposited by the\npetitioner with the respondent in respect of cash credit loan C.c.129.\n\n!For Petitioner\t ... M\/s.M.Senthil Kumar\n\n:ORDER\n<\/pre>\n<p>\tHeard Mr.D.Malaichamy, the learned counsel appearing on behalf of the<br \/>\npetitioner, as well as Mr.M.Senthil Kumar, the learned counsel appearing on<br \/>\nbehalf of the respondent.\n<\/p>\n<p>\t2. At this stage of the hearing of the writ petition, the learned  counsel<br \/>\nappearing  on  behalf  of  the  respondent had<br \/>\nsubmitted that the documents in question, which had been in the custody of the<br \/>\nrespondent bank, in respect of the mortgage, relating to the cash credit availed<br \/>\nby the petitioner, had been kept with the bank for providing collateral<br \/>\nsecurity, for the educational loan granted in favour of the petitioner&#8217;s<br \/>\nbrother&#8217;s daughter.\n<\/p>\n<p>\t3. In such circumstances, the relief prayed for, by the petitioner, in the<br \/>\npresent writ petition, cannot be granted.  Therefore, the writ petition stands<br \/>\ndismissed. No costs. However, it would be open to the petitioner to approach the<br \/>\nrespondent with a request to release some of the documents mortgaged with the<br \/>\nrespondent bank, if he is so advised.
