Justice ANTONY DOMINIC\n\n Dated :14\/08\/2008\n\n O R D E R\n                     ANTONY DOMINIC, J\n\n    -----------------------------------------------------------\n                     W.P.(C).No.21720\/2008\n    -----------------------------------------------------------\n          Dated this the 14th     day of August, 2008\n\n\n                           JUDGMENT\n<\/pre>\n<p>     Exts.P2 and P3 revenue recovery notices issued at the<\/p>\n<p>instance of the respondent Bank, for realising the dues of<\/p>\n<p>the petitioner are under challenge. Admittedly two loans<\/p>\n<p>have been availed of and default has been committed. In<\/p>\n<p>this writ petition, though several contentions have been<\/p>\n<p>urged, when the matter was taken up for admission, learned<\/p>\n<p>counsel for the petitioner confined his prayer for an<\/p>\n<p>instalment facility to discharge the dues to the Bank.<\/p>\n<p>     2. In view of the limited nature of the relief that is<\/p>\n<p>sought for, I heard the counsel for the respondent bank<\/p>\n<p>also in this matter. Having regard to the submissions I feel<\/p>\n<p>that, an opportunity should be extended to him to avoid<\/p>\n<p>coercive action as proposed in Exts.P2 and P3.<\/p>\n<p><span class=\"hidden_text\"> WP(c).No.21720\/2008        2<\/span><\/p>\n<p>      3. Therefore the writ petition is disposed of directing<\/p>\n<p>that the petitioner shall pay the amount due to the Bank in<\/p>\n<p>six equal monthly instalments, the first of which shall be<\/p>\n<p>paid on or before 29.8.2008. Subsequent instalments shall<\/p>\n<p>be paid on or before 29th of every succeeding month.
