Kutch, for<br \/>\n\tthe offences under Section 489(A),(B),(C) and (D) read with Section<br \/>\n\t120B of the Indian Penal Code.\n<\/p>\n<p>Heard<br \/>\n\tlearned Advocates for the respective parties.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate for the applicant has contended that the applicant is<br \/>\n\tinnocent and he is not involved in the alleged commission of<br \/>\n\toffence. He has contended that on the basis of statement of<br \/>\n\tco-accused Raimal @ Viro Rabari, the name of the applicant is<br \/>\n\tmentioned and thereafter second search was carried out by the<br \/>\n\tInvestigating Agency. He has contended that the statement of<br \/>\n\tco-accused cannot be considered against the present applicant. He<br \/>\n\thas contended that the applicant is the resident of Gandhidham and<br \/>\n\this address is wrongly shown by the Investigating Agency.  He has<br \/>\n\tcontended that simply on the statement of co-accused, the applicant<br \/>\n\tis wrongly booked in the commission of offence. Learned Advocate has<br \/>\n\tcontended that now the charge-sheet is filed and, therefore, there<br \/>\n\tis no question of tampering any evidence by the applicant.\n<\/p>\n<p>Learned<br \/>\n\tAPP has contended that, on the information received by the Police<br \/>\n\tfrom the co-accused Raymalbhai, second search was carried out and<br \/>\n\tthe Muddamal was recovered from the possession of the applicant. He<br \/>\n\thas contended that the co-accused has stated before the Police that<br \/>\n\tthe present applicant is also connected in the said offence at a<br \/>\n\tparticular place. He, therefore, contended that looking to the facts<br \/>\n\tof the case and, prima-facie, involvement of the applicant in the<br \/>\n\tcommission of offence, this Court may not entertain this<br \/>\n\tapplication.\n<\/p>\n<p>Heard<br \/>\n\tboth the parties. I have also perused the papers produced before me.<br \/>\n\tIt clearly appears from the statement of co-accused Raymal, second<br \/>\n\tsearch was carried out by the Investigating Agency and the Muddamal<br \/>\n\twas recovered from the possession of the applicant. Prima-facie, it<br \/>\n\tshows that there was agreement of present applicant with co-accused<br \/>\n\tRaymal. Therefore, prima facie, meeting of mind is established<br \/>\n\tagainst the present applicant. I am of the opinion that the<br \/>\n\tstatement of co-conspirator can be admissible against co-conspirator<br \/>\n\tin light of the definition of criminal conspiracy. This is a case of<br \/>\n\tcriminal conspiracy and, prima facie, I am of the opinion that there<br \/>\n\tis involvement of the applicant in the present matter. Therefore,<br \/>\n\tthis is a fit case to reject the application and, therefore, I do<br \/>\n\tnot deem it proper to entertain this application, filed by the<br \/>\n\tapplicant.\n<\/p>\n<p>In<br \/>\n\tview of above, this application is dismissed.
