MUNGER.\n                               Versus\n                          STATE OF BIHAR\n                            -----------\n<\/pre>\n<p>2.   19.1.2011.             Heard      Shri      Sanjeev    Ranjan,   learned<\/p>\n<p>                  counsel      for    the     petitioners      in    both   the<\/p>\n<p>                  cases    as    well      Shri     Anant   Kumar,     learned<\/p>\n<p>                  Additional Public Prosecutor.<\/p>\n<p>                            By   filing       two    petitions,      aforesaid<\/p>\n<p>                  two petitioners had prayed for granting bail<\/p>\n<p>                  in Bariyarpur P.S. Case No.99 of 2009, which<\/p>\n<p>                  was registered for the offence under Section<\/p>\n<p>                  302 and other allied Sections of the Indian<\/p>\n<p>                  Penal Code and Section 27 of the Arms Act.<\/p>\n<p>                            In       the    present    case,    F.I.R.      was<\/p>\n<p>                  lodged on the basis of fardbeyan of one Amod<\/p>\n<p>                  Mandal    wherein         he    alleged     that    in    his<\/p>\n<p>                  presence, his brother-in-law was surrounded<\/p>\n<p>                  by   about     seven      accused    persons       including<\/p>\n<p>                  both the petitioners and thereafter, accused<\/p>\n<p>                  Paro Singh @ Pramod Singh fired on temporal<\/p>\n<p>                  region    of   his       brother-in-law      i.e.    Chandan<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>Kumar. Subsequently, one Sanjay Mandal, son<\/p>\n<p>of     Chhote       Mandal    fired           on   the   back     of<\/p>\n<p>brother-in-law          of    the        informant.       Against<\/p>\n<p>Madan Mandal, who is petitioner in Cr. Misc.<\/p>\n<p>No.42508       of    2010,        allegation        is    that   he<\/p>\n<p>fired    on     informant          and    others,        but    none<\/p>\n<p>received any injury. So far as Sanjay Mandal<\/p>\n<p>in Cr. Misc. No.24749 of 2010 is concerned,<\/p>\n<p>there is general and omnibus allegation. No<\/p>\n<p>any specific act has been alleged against<\/p>\n<p>him.\n<\/p>\n<p>           Shri Sanjeev Ranjan, learned counsel<\/p>\n<p>for     the     petitioners,          while        pressing      the<\/p>\n<p>petition,       submits       that       in    police    station,<\/p>\n<p>this      informant          had         given       information<\/p>\n<p>regarding       murder       of    his      brother-in-law        by<\/p>\n<p>some un-known accused persons. Subsequently,<\/p>\n<p>fardbeyan, at the place of occurrence, was<\/p>\n<p>recorded in which he described regarding the<\/p>\n<p>occurrence       and     named        the      petitioners       and<\/p>\n<p>others.\n<\/p>\n<p>           Learned Additional Public Prosecutor<\/p>\n<p>has vehemently opposed the prayer of bail.<\/p>\n<p>However, he is not disputing the fact that<\/p>\n<p>informant had himself initially informed the<\/p>\n<p>police.       Thereafter,         a   station       diary      entry<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>        was     made,     which      has    been        recorded     in<\/p>\n<p>        paragraph-1 of the case diary.<\/p>\n<pre>                  In      view       of      the        facts       and\n\n        circumstances,         let    both        the    petitioners\n\n        above    named    be   enlarged      on     bail   on   their\n\n        furnishing        bond       of      Rs.10,000\/-           (ten\n\n<\/pre>\n<p>        thousand)each with two sureties of the like<\/p>\n<p>        amount     each        to     the     satisfaction           of<\/p>\n<p>        Additional Sessions Judge, F.T.C.II\/C.J.M.,<\/p>\n<p>        Munger    in     Bariyarpur        P.S.
