SASIDHARAN NAMBIAR, J.\n\n               -------------------------------------------------\n\n                         R.S.A.No. 4 OF 2009\n\n               --------------------------------------------------\n\n               Dated this the 7th day of April, 2009\n\n\n                            J U D G M E N T\n<\/pre>\n<p>           Legal heirs of the first defendant in O.S.126 of 1997<\/p>\n<p>on the file of Munsiff Court, Kannur are the appellants. The suit<\/p>\n<p>was filed for partition of the plaint schedule property which<\/p>\n<p>originally belonged to Kousalya. Kousalya admittedly died on<\/p>\n<p>7.7.1951 without leaving any husband or issues. Kousalya was a<\/p>\n<p>member of marumakkathayam tavazhi. Her mother was Thala.<\/p>\n<p>The other members of the tavazhy were her children Kousalya,<\/p>\n<p>Sukumaran, deceased first defendant and his sister Yesodha.<\/p>\n<p>Yesodha had three children, who are respondents 1 and 2, the<\/p>\n<p>plaintiffs 1 and 2 and respondent No.13, the second defendant.<\/p>\n<p>Children of first respondent are respondents 3 to 9 the plaintiffs<\/p>\n<p>3 to 9. Respondents 8 and 9 were admittedly born subsequent to<\/p>\n<p>1.12.1976, the date of coming into force of Kerala Joint Hindu<\/p>\n<p>Family (Abolition) Act. As on 1.12.1976, Kousalya there were 13<\/p>\n<p>members in the tavazhi. Yesodha died on 3.10.1996. Her rights<\/p>\n<p>devolved on her children. On the death of Kousalya on 7.7.1951<\/p>\n<p>RSA.4\/09-A<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>her right devolved on the tavazhi consisting of Thala and her<\/p>\n<p>children and their female descendants.       Respondents sought<\/p>\n<p>partition of the plaint schedule property contending that the<\/p>\n<p>properties are to be divided among the tavazhi members as on<\/p>\n<p>the date of Kerala Joint Hindu Family (Abolition) Act. Appellants<\/p>\n<p>admitted that the properties are available for division but<\/p>\n<p>contended that the properties cannot be divided among all<\/p>\n<p>members of the tavazhi and the division should be per capita and<\/p>\n<p>respondents 2 to 12 are not entitled to a share. It is contended<\/p>\n<p>that on the death of Kousalya her right on the property devolved<\/p>\n<p>on her brother, sisters and mother and it is to be divided equally<\/p>\n<p>among them and respondents 2 to 12 are not entitled to a share<\/p>\n<p>as sought for. Learned Munsiff on the evidence found that on<\/p>\n<p>the death of Kousalya her right reverted back to the tavazhi and<\/p>\n<p>as on the date of coming into force of Kerala Joint Hindu Family<\/p>\n<p>(Abolition) Act there were 13 members and each of them is<\/p>\n<p>entitled to one share.      A preliminary decree was passed<\/p>\n<p>accordingly. It was challenged before District Court, Thalassery<\/p>\n<p>in A.S.97 of 1998. Learned District Judge on reappreciation of<\/p>\n<p>evidence rejected the case of the appellants that division should<\/p>\n<p>RSA.4\/09-A<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>have been per capita. It was found that the properties were<\/p>\n<p>correctly divided as provided under the Marumakkathayam Act<\/p>\n<p>and the appeal was dismissed. The judgment is challenged in<\/p>\n<p>this second appeal.\n<\/p>\n<p>      2.   Learned counsel appearing for appellant was heard.<\/p>\n<p>      3.   The argument of the learned counsel is that as<\/p>\n<p>Kousalya died on 7.7.1951 her right devolved on her mother<\/p>\n<p>Thala and brother the first defendant and sister Yesodha, the<\/p>\n<p>property is to be divided on per capita basis and not by per<\/p>\n<p>stripes as done by the learned Munsiff and confirmed by the<\/p>\n<p>learned District Judge.   Learned counsel relied on the Full<\/p>\n<p>Bench decision of this Court in Sivasankaran Vs. Lakshmi &amp;<\/p>\n<p>Others (1966 KLT 327).\n<\/p>\n<p>      4.   On hearing the learned counsel, I do not find any<\/p>\n<p>substantial question of law involved in the appeal. As Kousalya<\/p>\n<p>died on 7.7.1951 who was admittedly a member of the<\/p>\n<p>Marumakkathayam tavazhi leaving behind no husband or issues,<\/p>\n<p>her right devolved on her tavazhi consisting of the mother Thala<\/p>\n<p>and brother deceased first defendant and sister deceased<\/p>\n<p>Yesodha and their female descendants. As rightly found by the<\/p>\n<p>RSA.4\/09-A<br \/>\n<span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>learned Munsiff and confirmed by the District Judge as on<\/p>\n<p>1.12.1976, the date of coming into force of Kerala Joint Hindu<\/p>\n<p>Family (Abolition) Act there were 13 members in the tavazhi<\/p>\n<p>including respondents 2 to 7 and 10 to 12. Respondents 8 and 9,<\/p>\n<p>who were born subsequent to that date are not entitled to claim<\/p>\n<p>a share by birth. All other members of the tavazhi are entitled to<\/p>\n<p>one share as granted by the courts below.\n<\/p>\n<p>         As there is no substantial question of law involved in the<\/p>\n<p>appeal, it is dismissed in limine.\n<\/p>\n<\/p>\n<p>                        M.
