MUKHOPADHAYA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/02\/2011 \n\n \n\n \n \n\n\n \n\nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE J.B.PARDIWALA)<\/p>\n<p>\tHeard<br \/>\nrespective counsel for the parties.\n<\/p>\n<p>\tThis<br \/>\nis an application for condonation of delay of 296 days in preferring<br \/>\nthe Letters Patent Appeal challenging the order passed by the learned<br \/>\nSingle Judge dated 4th December 2009.\n<\/p>\n<p>\tIn<br \/>\nthe application for condonation of delay, the applicants have<br \/>\nexplained the cause for delay, stating that after the order was<br \/>\npassed by learned Single Judge on 4th December 2009, the<br \/>\nlearned advocate appearing for the applicants communicated the same<br \/>\nto the Company on 7th December 2009 with an opinion that<br \/>\nappeal be preferred. It is further explained that some time was<br \/>\nconsumed by the Company in processing for obtaining sanction to file<br \/>\nLetters Patent Appeal.\n<\/p>\n<p>\tLearned<br \/>\ncounsel for the respondent has opposed this Application stating that<br \/>\nno sufficient cause has been assigned for condonation of delay.\n<\/p>\n<p>\tHaving<br \/>\ngone through the contents of the Application and the sufficient cause<br \/>\nassigned, we feel that delay deserves to be condoned and the same is<br \/>\nhereby condoned.
