No.27188 of 2010\n                                     MINTRA DEVI\n                                          Versus\n                                THE STATE OF BIHAR\n                                        -----------\n<\/pre>\n<p>3   19.11.2010             Heard learned counsel for the petitioner<\/p>\n<p>                 and learned counsel for the State.\n<\/p>\n<p>                           Petitioner Mintra Devi apprehends her arrest in<\/p>\n<p>                 connection with Hilsa (Karai) P.S. Case No.461 of 2009<\/p>\n<p>                 registered under Section 304(B)\/34 of the I.P.C.<\/p>\n<p>                           Admittedly, petitioner is mother-in-law of the<\/p>\n<p>                 deceased and it is alleged that the marriage of deceased<\/p>\n<p>                 had taken place three years ago with son of the petitioner,<\/p>\n<p>                 but subsequently she was subjected to cruelty and<\/p>\n<p>                 harassment on account of illegal demand and lastly she was<\/p>\n<p>                 done to death by her husband and other in-laws.<\/p>\n<p>                           The contention of learned counsel for petitioner is<\/p>\n<p>                 that earlier the deceased was married with the elder son of<\/p>\n<p>                 the petitioner, but unfortunately the elder son of the<\/p>\n<p>                 petitioner died and after that the marriage of deceased was<\/p>\n<p>                 solemnized with the younger son of the petitioner, so the<\/p>\n<p>                 question of demand of dowry does not arise. He further<\/p>\n<p>                 submitted that as a matter of fact the deceased was<\/p>\n<p>                 suffering from mental depression after death of her first<\/p>\n<p>                 husband and that was the reason she committed suicide,<\/p>\n<p>                 but taking the advantage of death of deceased the informant<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>       lodged the instant case against the petitioner. Learned<\/p>\n<p>       counsel for petitioner referred para-18, 19 and 20 in support<\/p>\n<p>       of his above stated contention.\n<\/p>\n<p>                  From perusal of F.I.R. as well as materials<\/p>\n<p>       available on record, I found that the entire allegation centres<\/p>\n<p>       around against the husband of the deceased and it is co-<\/p>\n<p>       accused Arvendra Kumar @ Manjhi who demanded money<\/p>\n<p>       from informant as well as deceased.\n<\/p>\n<p>                  Therefore,      in   the    aforesaid   circumstance<\/p>\n<p>       petitioner, namely, Mintra Devi, in the event of her arrest<\/p>\n<p>       \/surrender within 30 days from the date of<\/p>\n<p>       communication of this order to the concerned court<\/p>\n<p>       in connection with Hilsa (Karai) P.S.
