No.961 of 2010\n                  = = = = = = = = = = = = = = = = =\n               Dated, this the 17th day of March,2010\n\n                               O R D E R\n<\/pre>\n<p>      In this Revision Petition filed under Section 397 read with Sec.<br \/>\n401 Cr.P.C. the petitioner who was the accused in C.C.No.496 of<br \/>\n2005 on the file of the J.F.C.M-I, Aluva challenges the conviction<br \/>\nentered and the sentence passed against            her for an offence<br \/>\npunishable under Sec. 138 of the Negotiable Instruments Act, 1881<br \/>\n(hereinafter referred to as &#8216;the Act&#8217;).   The   cheque     amount    was<br \/>\nRs.75,000\/-. The compensation ordered by the lower appellate court is<br \/>\nRs.75,000\/-.\n<\/p>\n<p>      2.    I heard the learned counsel for the Revision Petitioner and<br \/>\nthe learned Public Prosecutor.\n<\/p>\n<p>      3.    The learned counsel appearing for the Revision Petitioner<br \/>\nre-iterated the contentions in support of the Revision.\n<\/p>\n<p>      4.     The courts below have concurrently held that the cheque<br \/>\nin question was drawn by the petitioner in favour of the complainant,<br \/>\nthat the complainant had validly complied with clauses (a) and (b) of<br \/>\nthe proviso to Section 138 of the Act. and that the Revision<br \/>\nPetitioner\/accused failed to make the payment within 15 days of<br \/>\nreceipt of the statutory notice. Both the courts have considered and<br \/>\nrejected the defence set up by the revision petitioner while entering<br \/>\nthe conviction.     The said conviction has been recorded after a<br \/>\ncareful evaluation of the oral and documentary evidence. This Court<br \/>\nsitting in the rarefied revisional jurisdiction will be loath to interfere<\/p>\n<p><span class=\"hidden_text\">Crl.R..P. No.961\/2010                 -:2:-<\/span><\/p>\n<p>with the findings of fact recorded by the courts below concurrently do<br \/>\nnot find any error, illegality or impropriety in the conviction          so<br \/>\nrecorded concurrently by the courts below and the same is hereby<br \/>\nconfirmed.\n<\/p>\n<p>       5.     What now survives for consideration is the legality of the<br \/>\nsentence imposed on the revision petitioner.            In the light of the<br \/>\ndecision of the Supreme Court in Ettappadan Ahammedkutty v. E.P.<br \/>\nAbdullakoya &#8211; 2008 (1) KLT 851 default sentence cannot be imposed<br \/>\nfor the enforcement of an order for compensation under Sec. 357 (3)<br \/>\nCr.P.C.     I am, therefore, inclined to modify the sentence to one of<br \/>\nfine only. Accordingly, for the conviction under Section 138 of the<br \/>\nAct the revision petitioner is sentenced to pay a fine of Rs.80,000\/-<br \/>\n(Rupees eighty thousand only).             The said  fine shall be paid as<br \/>\ncompensation under Section 357 (1) Cr.P.C. The revision petitioner is<br \/>\npermitted either to deposit the said fine amount before the Court<br \/>\nbelow or directly pay the compensation to the complainant within<br \/>\nfive months from today and produce a memo to that effect before the<br \/>\ntrial Court in case of direct payment. If she fails to deposit or pay the<br \/>\nsaid    amount within the aforementioned period           she shall suffer<br \/>\nsimple imprisonment for three months by way of default sentence.\n<\/p>\n<p>       In the result, this Revision is disposed of confirming the<br \/>\nconviction     entered but modifying the sentence         imposed on the<br \/>\nrevision petitioner.\n<\/p>\n<p>       Dated this the 17th day of March, 2010.\n<\/p>\n<p>                                                   V.
