Agarwal, J. <\/p>\n<p> This is a petition under Section 438 Cr.P.C.<br \/>\nread with Section 482 Cr.P.C. for anticipatory bail in<br \/>\nthe case FIR No. 236\/2000 under Sections<br \/>\n420\/467\/471\/448\/120B IPC P.S. Inderpuri.\n<\/p>\n<p> 1. Facts in brief are that Tapan Lahiri lodged a<br \/>\nreport alleging that he was defrauded by the petitioner<br \/>\nfor forging documents of flat No. A-83, Inderpuri, New<br \/>\nDelhi (hereinafter, &#8220;the flat&#8221;); that in 1992 he<br \/>\npurchased that flat in the name of his firm Kaspat Exports<br \/>\nfor Rs. 1,95,000\/- from M\/s. Cubical Constructions Private<br \/>\nLtd.; that he procured a bank loan from the Bank of<br \/>\nBaroda for business purposes and submitted the original<br \/>\nproperty papers of the flat to the bank as a security.<br \/>\nThe petitioner was earlier his landlord and had some<br \/>\nbusiness dealing with him. Because of the financial<br \/>\nconstraints he could not re-pay the loan to the bank as a<br \/>\nresult of which the bank instituted a suit for recovery in<br \/>\nthe Debt Recovery Tribunal. He had left Delhi and<br \/>\nproceeded ex parte; on enquiries from the bank,<br \/>\npetitioner moved an application before the DRT for being<br \/>\nimp leaded as a party to the proceedings stating that he<br \/>\nwas the sole owner of the said flat and that the<br \/>\ncomplainant had executed the sale deed in his favor, in<br \/>\npursuance to the decree dated 23rd August, 1996 passed by<br \/>\nSh. Prithvi Raj, then Addl. District Judge of which he<br \/>\nhas no knowledge. He further alleged that his signatures<br \/>\non all the documents of sale have been forged and<br \/>\nfabricated and that he never executed any documents in<br \/>\nfavor of the petitioner or issued any receipt regarding<br \/>\nthe sale of the said flat. On the said complaint, above<br \/>\ncase was registered. The investigations are in progress.\n<\/p>\n<p> 2. Learned APP for the State at the outset argued<br \/>\nthat petitioner was earlier involved in two criminal cases<br \/>\nbeing FIR No. 182\/97 under Sections 3\/4\/5 ITP Act P.S.<br \/>\nRajouri Garden and FIR No. 372\/83 under Section 7 of<br \/>\nEssential Commodities Act. Learned Counsel for the<br \/>\npetitioner contests the same. Learned APP further argued<br \/>\nthat petitioner had earlier lodged three FIRs. being Nos.<br \/>\n777\/98 under Section 506 IPC, 934\/98 under Section 389\/506<br \/>\nIPC and 935\/98 under Sections 341\/354 IPC. All these<br \/>\nFIRs. on investigation were found to be false and were<br \/>\ncancelled and the allegations were not substantiated.<br \/>\nLearned counsel for the petitioner does not contest the<br \/>\nsame.\n<\/p>\n<p> 3. Learned APP also argued that in May, 2001<br \/>\npetitioner filed a complaint against the complainant<br \/>\nalleging that the flat in question was agreed to be sold<br \/>\nby the complainant to him and had taken some money but he<br \/>\ndishonestly mortgaged the flat, to the bank. On the basis<br \/>\nof this complaint FIR was registered; the matter was<br \/>\ninvestigated. FSL report revealed that the signatures of<br \/>\ncomplainant on the agreement relied upon by the<br \/>\npetitioner, were opined to be forged. A cancellation<br \/>\nreport has already been filed. He further argued that<br \/>\nstatements of stamp vendors, who had allegedly sold the<br \/>\nstamp papers on which sale deed was typed, have<br \/>\nbeen recorded. As per the report the stamp vendors never<br \/>\nsold these stamp papers. He argued that custodial<br \/>\ninterrogation of the petitioner is required, to locate the<br \/>\nsource wherefrom the stamp papers were procured, when the<br \/>\nforgery was committed.\n<\/p>\n<p> 4. Learned counsel for the petitioner vehemently<br \/>\ncountering the allegations argued that there is dispute<br \/>\nbetween the petitioner and one Manmeet Singh, who are<br \/>\npresent in the court, in respect of some other property<br \/>\nwhich he sought to be purchased for Rs. 87 lacs on 14th<br \/>\nJanuary, 2000; that he had paid only Rs. 19.9 lacs. Civil<br \/>\nlitigation between the parties is pending. The petitioner<br \/>\nhas lodged a report against the Manmeet Singh, his wife<br \/>\nand his lawyer. And a vigilance enquiry is pending with<br \/>\nDCP-Vigilance as well as with Bar Council. He further<br \/>\nargued that the complainant did not lodge any report from<br \/>\n1992 till 2000, and the delay by itself shows that the<br \/>\npresent complainant has been prompted by Mr. Manmeet Singh<br \/>\nas a counter blast. The petitioner has already<br \/>\nparticipated in the investigations; and that he is ready<br \/>\nand willing to abide by any other condition, therefore, he<br \/>\nis entitled for anticipatory bail. Learned APP submits<br \/>\nthat no vigilance inquiry is pending.\n<\/p>\n<p> 5. I have considered the rival contentions. As per<br \/>\nthe petitioner&#8217;s own showing, on the basis of complaint<br \/>\nlodged by him FIR NO. 469\/2000 was registered against the<br \/>\ncomplaint. The investigations were carried out and as<br \/>\nper FSL report, the signature of the complainant on the<br \/>\ndocuments relied upon by the petitioner have been found to<br \/>\nbe forged and fabricated. Further it is not denied that<br \/>\npetitioner&#8217;s earlier three FIRs. Were found to be false<br \/>\nand were cancelled. Other arguments raised by the counsel<br \/>\nfor petitioner that there is delay in lodging FIR; that<br \/>\nthe same was lodged at the behest of Manmeet Singh or that<br \/>\nvigilance inquiry, against Manmeet Singh his wife and his<br \/>\ndaughter and his lawyer in respect of another property<br \/>\nbetween the petitioner and Manmeet Singh, is pending<br \/>\n(which is contested by learned counsel for respondent),<br \/>\ncannot help the petitioner, at this stage.\n<\/p>\n<p> 6. The question whether a person is entitled to the<br \/>\ngrant of anticipatory bail or not depends upon variety of<br \/>\ncircumstances and the cumulative effect of the various<br \/>\nfacts obtained in a given case. Mere delay in lodging the<br \/>\nreport cannot be treated as sole ground for granting<br \/>\nanticipatory bail. On the other hand, if a person is not<br \/>\nhaving clean antecedents, this itself can be a ground for<br \/>\nrefusing pre-arrest bail.\n<\/p>\n<p> 7. In this case, looking into the nature of<br \/>\nallegations, more particularly the fact that signatures of<br \/>\nthe complainant on the sale documents being relied upon by<br \/>\nthe petitioner have been found to be forged by FSL; the report of the Stamp Authority that no such paper was soled<br \/>\nby the stamp vendors, and the past record of the<br \/>\npetitioner, no case for grant of anticipatory bail is made<br \/>\nout.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Delhi High Court Shri G.P.S.
