Notification has been issued in exercise of powers under<br \/>\n\tSection 268 of the Code of Criminal Procedure. Persons named in the<br \/>\n\tsaid notification are directed not to be removed from Sabarmati<br \/>\n\tCentral Prison, Ahmedabad.\n<\/p>\n<p>Previously<br \/>\n\tsome of the accused covered in this very notification had approached<br \/>\n\tthis Court challenging legality thereof. By order dated 15.7.2010<br \/>\n\tpassed in Special Criminal Application No. 1204\/2010 and connected<br \/>\n\tmatter, following observations and directions were made :\n<\/p>\n<p> Rule.\n<\/p>\n<p>Learned APP Mr. Nanavaty  and Ms. Shah waives service of rule for<br \/>\nrespondent State in the respective petitions.\n<\/p>\n<p>The<br \/>\npetitioner original accused no.31 in the complaint being C.R.<br \/>\nNo.I-252\/2009 registered before Odhav police station has challenged<br \/>\nvalidity of Government notification dated 22.10.2009 by which the<br \/>\nGovernment in exercise of powers under Sub-section(1) of Section 268<br \/>\nof the Code of Criminal Procedure was pleased to provide as under :\n<\/p>\n<p> And<br \/>\nwhereas they are at present detained in Sabarmati Central Prison,<br \/>\nAhmedabad. Now therefore, in exercise of powers conferred by<br \/>\nSub-Section(1) of section 268 of the Criminal Procedure Code 1973 the<br \/>\nGovernment of Gujarat hereby having regard to <\/p>\n<p>(a)<br \/>\nthe nature of the offences for which or the grounds on which, the<br \/>\nsaid persons have been ordered to be confirmed or detain in prison<\/p>\n<p>(b)<br \/>\nthe likely hood of the disturbance of Public order if the said<br \/>\npersons are allowed to be removed from the prison, and<\/p>\n<p>(c)<br \/>\nThe public interest generally directs that they shall not be removed<br \/>\nfrom the Sabarmati Central Prison, Ahmedabad.\n<\/p>\n<p>\tIt<br \/>\nis not in dispute that with respect to certain other co-accused, this<br \/>\nCourt had occasion to deal with the same notification. In Criminal<br \/>\nMisc. Application No.2639\/2010 by order dated 3.5.2010, Learned<br \/>\nSingle Judge observed as under :\n<\/p>\n<p> Having<br \/>\nheard learned advocates for the parties and on perusal of the record<br \/>\nof the case, including impugned notifications\/orders, prima<br \/>\nfacie, I am of the opinion that<br \/>\nthe same are devoid of any reasons.  On  the contrary, the above<br \/>\nnotifications simply reproduced provisions of section 268 of the Code<br \/>\nand no material appears on record about likelihood of disturbance of<br \/>\npublic order if the person or class of persons are allowed to be<br \/>\nremoved from the prison.  It also appears that  the State Government<br \/>\nhas nowhere considered the nature of offence and grounds on which the<br \/>\nimpugned orders are passed.  Besides, all the applicants are women<br \/>\narrested mainly on the ground of their role attributed in the<br \/>\ninvolvement of crime basically under the Bombay Prohibition Act and<br \/>\nconsidering the gravity of offences, charges under Sections 302 and<br \/>\n304 of the IPC are added.  Be that as it may, at this<br \/>\nstage, this court is not on levelling of charges against the<br \/>\napplicants-accused but about validity and legality of exercising<br \/>\npowers under Section 268 of the Code.  Therefore, a case is made out<br \/>\nin favour of the applicants and the operation of notifications<br \/>\nimpugned qua the applicants shall remain stayed.\n<\/p>\n<p>\tFacts<br \/>\nbeing identical and notification being common, I am inclined to take<br \/>\nthe same view. Though while quashing the impugned notification dated<br \/>\n22.10.2009 qua the present petitioner, it must be observed that<br \/>\ninterference by High Court was and is on account of non sufficiency<br \/>\nof reasons before the Government proceeded to issue notification<br \/>\nunder Secton 268(1) of the Code of Criminal Procedure. Therefore,<br \/>\ndespite this order it would always be open for the Government to pass<br \/>\nfresh orders in accordance with law, if facts so required.\n<\/p>\n<p>\tIn<br \/>\nthe result, petitions are allowed. Notification dated 22.10.2009 is<br \/>\nquashed.
