Justice K.SURENDRA MOHAN\n\n Dated :27\/05\/2010\n\n O R D E R\n                K.SURENDRA MOHAN, J.\n             -------------------------------------------\n                W.P.(C) No.15618 of 2010\n             -------------------------------------------\n          Dated this the 27th day of May, 2010\n\n                          JUDGMENT\n<\/pre>\n<p>   The petitioner, a stage carriage operator has filed this<\/p>\n<p>Writ Petition challenging Ext.P4 order of the first<\/p>\n<p>respondent directing him to apply for a fresh permit on<\/p>\n<p>the route for his new vehicle. The petitioner is conducting<\/p>\n<p>services on the route Koothattukulam-Thodpuzha on the<\/p>\n<p>strength of a regular permit that is valid till 17.8.2011. He<\/p>\n<p>applied for replacement of his existing vehicle with a later<\/p>\n<p>model vehicle bearing Reg.No.KL-17\/D 5599. However,<\/p>\n<p>the application for replacement was not considered by the<\/p>\n<p>second respondent stating that there is more than 25%<\/p>\n<p>difference in seats between the original vehicle and the<\/p>\n<p>vehicle that is produced for replacement. The petitioner<\/p>\n<p>then   approached        this    Court       by     filing W.P.(C)<\/p>\n<p>No.13560\/2010 challenging the said proceedings of the<\/p>\n<p>second respondent. This Court directed a consideration of<\/p>\n<p>the application for replacement.\n<\/p>\n<p>     2. Pursuant to the judgment of this Court, the<\/p>\n<p><span class=\"hidden_text\">WPC No.15618\/2010        2<\/span><\/p>\n<p>  Regional Transport Authority considered the application<\/p>\n<p>  by circulation and the Deputy Transport Commissioner<\/p>\n<p>  directed grant of the replacement. However, the District<\/p>\n<p>  Collector, Chairman of the RTA directed the petitioner to<\/p>\n<p>  file an application for a fresh permit. The petitioner is<\/p>\n<p>  aggrieved by the said direction.\n<\/p>\n<p>        3. According to the counsel for the petitioner, it is<\/p>\n<p>  not necessary for the petitioner to file a fresh application<\/p>\n<p>  in view of Section 80(3) of the Motor Vehicles Act, 1988<\/p>\n<p>  and Rule 174(3) of the Kerala Motor Vehicles Rules. The<\/p>\n<p>  learned Senior Government Pleader opposes the above<\/p>\n<p>  submission by pointing out that there is a variation in the<\/p>\n<p>  seating capacity between the earlier vehicle and that the<\/p>\n<p>  vehicle that is offered for replacement. The earlier vehicle<\/p>\n<p>  has only a seating capacity of 28 while the present vehicle<\/p>\n<p>  has a seating capacity of 38.\n<\/p>\n<p>        4. I have heard the counsel for the petitioner as well<\/p>\n<p>  as the learned Senior Government Pleader.<\/p>\n<p>        5. Rule 174(3) reads as follows:\n<\/p>\n<p>            &#8220;If the new vehicle proposed does not differ<br \/>\n           in material respects from the old, the<br \/>\n           application for replacement of the vehicle<\/p>\n<p><span class=\"hidden_text\">WPC No.15618\/2010        3<\/span><\/p>\n<p>           may be allowed.        If there is material<br \/>\n           difference between the two vehicles, the<br \/>\n           application shall be treated as if it were for a<br \/>\n           fresh permit&#8221;.\n<\/p>\n<p>         It can be seen from the above that in cases where<\/p>\n<p>  the new vehicle that is offered differs materially from the<\/p>\n<p>  vehicle that was earlier being used, the application is to be<\/p>\n<p>  treated as if it were one for a fresh permit. A similar<\/p>\n<p>  provision is available in the case of variation of conditions<\/p>\n<p>  of permit also in Section 80(3). Section 80(3) reads as<\/p>\n<p>  follows:\n<\/p>\n<blockquote><p>         &#8220;An application to vary the conditions of any<br \/>\n         permit, other than a temporary permit, by<br \/>\n         the inclusion of a new route or routes or a<br \/>\n         new area or by altering the route or routes<br \/>\n         or area covered by it, or in the case of a<br \/>\n         stage carriage permits by increasing the<br \/>\n         number     of  trips  above    the    specified<br \/>\n         maximum or by the variation, extension or<br \/>\n         curtailment of the route or routes or the<br \/>\n         area specified in the permit shall be treated<br \/>\n         as an application for the grant of a new<br \/>\n         permit&#8221;.<\/p><\/blockquote>\n<p>        7. In both these provisions, it is not required for the<\/p>\n<p>  applicant to make a fresh application. In the contingency<\/p>\n<p>  that is contemplated by the above provisions, the authority<\/p>\n<p>  is directed to treat the pending application as one for the<\/p>\n<p>  issue of a fresh permit and to consider the same on the<\/p>\n<p><span class=\"hidden_text\">WPC No.15618\/2010        4<\/span><\/p>\n<p>  merits. In view of the above, the direction in Ext.P4 to the<\/p>\n<p>  petitioner to apply for a fresh permit in respect of the new<\/p>\n<p>  vehicle is absolutely unjustified and uncalled for.      The<\/p>\n<p>  respondents are bound to pass orders on the application<\/p>\n<p>  submitted by the petitioner, treating the same as an<\/p>\n<p>  application for a fresh permit, if it is found that there is<\/p>\n<p>  difference between the original vehicle and the new<\/p>\n<p>  vehicle in any material particulars.\n<\/p>\n<p>        8. In view of the above, the condition in Ext.P4 is<\/p>\n<p>  unsustainable and the same is set aside.
