it   By its judgment and award, the Tribunal has<\/p>\n
 ai\ufb01tarded a sum of Rs.I,09,000\/– with interest at 6%<\/p>\n
 from the date of petition till its realization as<\/p>\n
against the claim made by the appellant for a sum of
\nRs.2,75,000\/–, on account of the injuries by
\nhim in the road traffic accident. f A<\/p>\n

\n2.1.1995  from Chittoor
\ntowards   “the lorry bearing
\n   with poultry feeds and
\nwhen   ‘$o’rne’shwarapalya Tank on Ko1ar–<\/p>\n
Mulbagal  the driver of lorry bearing<\/p>\n
 No’;’-If\/iHLii2’IQ.993  from opposite direction in a<\/p>\n
 “negligent manner and dashed against the<\/p>\n
lorry appellant, due to Which, he sustained auto<\/p>\n
 arnptitation of 5″‘, \u00e9iih and 3rd toes of right leg, fracture<\/p>\n
if  patella and fracture of upper third tibia.<\/p>\n
  ~-irnmediately, he has been shifted to SNR Hospital, Kolar<\/p>\n
where he has taken treatment as inpatient for 1 1\/2<\/p>\n

months, undergone two surgeries and spent reasonable
\namount towards medical expenses, conveyance and<\/p>\n
other incidental charges. On account of the..Vin’j”u.ries<\/p>\n
sustained by the appellant in the said accid\u00a7e.nt;l<\/p>\n
suffered permanent disability. ‘.l_y’he__Doc_ior  ‘ass’essec1″*. <\/p>\n
the functional disability at 106%, if 6G%”to <\/p>\n
lower limb and at 35% ‘to._v”‘thVe whole.boldy\ufb01\ufb01fherefore;at<\/p>\n
appellant has \ufb01led a claiIn…pe’tition_ befo’r–e._th,e\u00a7 Tribunal
\nclaiming compensation he — A   b respondents. The<\/p>\n
said claim petition h;aVd’c’o1\u00e9r1e4’up.forconsideration before<\/p>\n
the  flllfile  hearing both sides
\nand after  and documentary evidence,<\/p>\n
has allowed    petition in part and awarded<\/p>\n
   Rs…p1,09l,OO’OV\/– as compensation under different<\/p>\n
  vinlterest at 6% pa, from the date of petition<\/p>\n
ti1l..__its__>re.a.}isation. Being aggrieved by the quantum of<\/p>\n
 xcompentsation awarded by the Tribunal and also for not<\/p>\n
W_awa’rding any compensation towards loss of amenities<\/p>\n

this appeal, seeking eirhancement of compensation.<\/p>\n

about the occurrence of the accident and the injuries
\nsustained by the appellant in the said accident. It is
\nalso not in dispute that, on account of the injuries<\/p>\n
sustained by the appellant, he has taken treatIrient_ as<\/p>\n
inpatient for one and half months, <\/p>\n
surgeries and during the said period he  lot it ‘ <\/p>\n
of pain and agony and he might  <\/p>\n
amount towards conveyance and VoptherfiricidentaiV<\/p>\n
charges. Further, in View,3-of–.the”injuries’sustained by<\/p>\n
the appellant, he  disability.\n<\/p>\n
The :vIjdcte1}iv:,fv1ails:7{‘v functional disability at<\/p>\n
