Oral\n<\/pre>\n<p>*<\/p>\n<p>W.P.(C) No. 3403\/2011<\/p>\n<p>              By this petition filed under Article 226 of the<\/p>\n<p>Constitution of India, the petitioner seeks directions to direct<\/p>\n<p><span class=\"hidden_text\">W.P.(C) 3403\/2011                             Page 1 of 7<\/span><br \/>\n the respondents         to re-schedule   the date of LLB Entrance<\/p>\n<p>Examination of Delhi University          from 12.6.2011       to some<\/p>\n<p>other convenient date.\n<\/p>\n<p>              Brief facts as set out in the present petition are<\/p>\n<p>that the petitioner who is an Indian citizen and a graduate<\/p>\n<p>and M.Phil from Cambridge University wishes to take the<\/p>\n<p>LLB Entrance Test scheduled for 12.6.2011 and also wishes<\/p>\n<p>to appear for the preliminary examination of Civil Services,<\/p>\n<p>2011, scheduled for the same date i.e. 12.6.2011.<\/p>\n<p>              It    has been stated that on 19.2.2011 the UPSC<\/p>\n<p>had issued an advertisement inviting applications of eligible<\/p>\n<p>candidates and fixed the date of its preliminary examination<\/p>\n<p>as 12.6. 20011. The petitioner submitted his application on<\/p>\n<p>21.2.2011          to appear in the said examination but he        is<\/p>\n<p>wanting to pursue academic          professional    course of Law<\/p>\n<p>also. It is further submitted that the petitioner had made a<\/p>\n<p>representation         dated 19.4.2011    to the Vice Chancellor,<\/p>\n<p>University of Delhi, requesting him to change the date of<\/p>\n<p>entrance test for LLB entrance exam as otherwise a large<\/p>\n<p><span class=\"hidden_text\">W.P.(C) 3403\/2011                               Page 2 of 7<\/span><br \/>\n number of students would have their hands tied down and<\/p>\n<p>they will be forced to make a choice to appear in one of the<\/p>\n<p>exams, but the same was however rejected.\n<\/p>\n<pre>              Mr.     Dubey,     counsel      for    the    petitioner        has\n\nvehemently          submitted     that     the      right    to       education\n\nis a fundamental right of the petitioner, of which                    he cannot\n\n<\/pre>\n<p>be deprived of. Counsel thus further states that the fixing of<\/p>\n<p>dates for the exams is in the realm of the administration and<\/p>\n<p>the administrative convenience of the respondents cannot<\/p>\n<p>come in the way of the petitioner to deprive him from<\/p>\n<p>appearing in         the civil service exams.           In support of his<\/p>\n<p>arguments, Mr. Dubey has placed reliance on the judgment<\/p>\n<p>of the Apex court in Avinash Mehrotra Vs. Union of India<\/p>\n<p>&amp; Ors. (2009)          6 SCC 398 with special emphasis on the<\/p>\n<p>following paras:\n<\/p>\n<p>\n   &#8220;23. The Kothari Commission on Education set up by the Government<br \/>\n   of India in 1966 strongly recommended free and compulsory education<br \/>\n   for children up to 14 years. The Commission observed that there is no<br \/>\n   other way for the poor to climb their way out of this predicament.<\/p>\n<p>   24. Education occupies a sacred place within our Constitution and<br \/>\n   culture. Article 21A of the Constitution, adopted in 2002, codified this<br \/>\n   Court&#8217;s holding in Unni Krishnan, J.P. and Ors. v. State of Andhra<br \/>\n   Pradesh and Ors. : [1993]1SCR594 , in which we established a right<\/p>\n<p><span class=\"hidden_text\">W.P.(C) 3403\/2011                                       Page 3 of 7<\/span><br \/>\n    to education. Parliament did not merely affirm that right; the Amending<br \/>\n   Act placed the right to education within the Constitution&#8217;s set of<br \/>\n   Fundamental Rights, the most cherished principles of our society. As<br \/>\n   the Court observed in Unni Krishnan (supra), para 8:<\/p>\n<p>   The immortal Poet Valluvar whose Tirukkural will surpass all ages and<br \/>\n   transcend all religious said of education:\n<\/p>\n<p>   Learning is excellence of wealth that none destroy; To man nought else<br \/>\n   affords reality of joy.\n<\/p>\n<p>   25. Education today remains liberation &#8211; a tool for the betterment of<br \/>\n   our civil institutions, the protection of our civil liberties, and the path to<br \/>\n   an informed and questioning citizenry.\n<\/p>\n<p>   26. Then as now, we recognize education&#8217;s &#8220;transcendental importance&#8221;<br \/>\n   in the lives of individuals and in the very survival of our Constitution<br \/>\n   and Republic. In the years since the inclusion of Article 21A, we have<br \/>\n   clarified that the right to education attaches to the individual as an<br \/>\n   inalienable human right. We have traced the broad scope of this right in<br \/>\n   <a href=\"\/doc\/1113296\/\">R.D. Upadhyay v. State of A.P. and Ors.<\/a> : AIR2006SC1946 ,<br \/>\n   holding that the State must provide education to all children in all<br \/>\n   places, even in prisons, to the children of prisoners. We have also<br \/>\n   affirmed the inviolability of the right to education. <a href=\"\/doc\/1382544\/\">In Election<br \/>\n   Commission of India v. St. Mary&#8217;s School and Ors.<\/a>                      :<br \/>\n   AIR2008SC655 , we refused to allow the State to take teachers from<br \/>\n   the classroom to work in polling places. While the democratic State has<br \/>\n   a mandate to conduct elections, the mundane demands of instruction<br \/>\n   superseded the State&#8217;s need to staff polling places. Indeed, the<br \/>\n   democratic State may never reach its greatest potential without a<br \/>\n   citizenry sufficiently educated to understand civil rights and social<br \/>\n   duties, <a href=\"\/doc\/595099\/\">Bandhua Mukti Morcha v. Union of India and Ors.<\/a> :<br \/>\n   [1997]2SCR379 . These conclusions all follow from our opinion in Unni<br \/>\n   Krishnan. Education remains essential to the life of the individual, as<br \/>\n   much as health and dignity, and the State must provide it,<br \/>\n   comprehensively and completely, in order to satisfy its highest duty to<br \/>\n   citizens.\n<\/p>\n<p>   27. Unlike other fundamental rights, the right to education places a<br \/>\n   burden not only on the State, but also on the parent or guardian of<br \/>\n   every child, and on the child herself. Article 21A, which reads as<br \/>\n   follows, places one obligation primarily on the State:<\/p>\n<p>   The State shall provide free and compulsory education to all children of<br \/>\n   the age of six to fourteen years in such manner as the State may, by<br \/>\n   law, determine.\n<\/p>\n<p>\n<span class=\"hidden_text\">W.P.(C) 3403\/2011                                            Page 4 of 7<\/span>\n<\/p>\n<p>    28. By contrast, Article 51A(k), which reads as follows, places burden<br \/>\n   squarely on the parents:\n<\/p>\n<p>   Fundamental duties &#8211; it shall be the duty of every citizen of India who is<br \/>\n   the parent or guardian to provide opportunities for education to his<br \/>\n   child or, as the case may be, ward between the age of six and fourteen<br \/>\n   years.\n<\/p>\n<p>   29. The Constitution directs both burdens to achieve one end: the<br \/>\n   compulsory education of children, free from the fetters of cost, parental<br \/>\n   obstruction, or State inaction. The two articles also balance the relative<br \/>\n   burdens on parents and the State. Parents sacrifice for the education of<br \/>\n   their children, by sending them to school for hours of the day, but only<br \/>\n   with a commensurate sacrifice of the State&#8217;s resources. The right to<br \/>\n   education, then, is more than a human or fundamental right. It is a<br \/>\n   reciprocal agreement between the State and the family, and it places<br \/>\n   an affirmative burden on all participants in our civil society.<\/p>\n<p>   30. This Court has routinely held that another fundamental right to life<br \/>\n   encompasses more than a breath and a heartbeat. In reflecting on the<br \/>\n   meaning of &#8220;personal liberty&#8221; in Articles 19 and 21, we have held that<br \/>\n   &#8220;that `personal liberty&#8217; is used in the article as a compendious term to<br \/>\n   include within itself all the varieties of rights which go to makeup the<br \/>\n   `personal liberties&#8217; of man.&#8221; <a href=\"\/doc\/619152\/\">Kharak Singh v. State of U.P. and Ors.<\/a><br \/>\n   : 1963CriLJ329 . Similarly, we must hold that educating a child requires<br \/>\n   more than a teacher and a blackboard, or a classroom and a book. The<br \/>\n   right to education requires that a child study in a quality school, and a<br \/>\n   quality school certainly should pose no threat to a child&#8217;s safety. We<br \/>\n   reached a similar conclusion, on the comprehensive guarantees implicit<br \/>\n   in the right to education, only recently in our opinion in <a href=\"\/doc\/1299440\/\">Ashoka Kumar<br \/>\n   Thakur v. Union of India and Ors.<\/a> : (2008)6SCC1&#8243;<\/p>\n<pre>       On the other hand,               Mr. Rupal , learned counsel\n\nappearing for the respondent submits that                  it is for a student\n\n<\/pre>\n<p>to decide whether he intends to pursue an academic<\/p>\n<p>professional course or opt for employment. He further states<\/p>\n<p>that     if the petitioner considers himself to be meritorious<\/p>\n<p><span class=\"hidden_text\">W.P.(C) 3403\/2011                                         Page 5 of 7<\/span><br \/>\n enough to appear in the civil service exams, then he would be<\/p>\n<p>only blocking the seat of LLB Course.\n<\/p>\n<p>               I have heard learned counsel for the parties.\n<\/p>\n<p>               It is a matter of fact that there are hundreds of<\/p>\n<p>important entrance examinations which take place                  during<\/p>\n<p>these days and the students         have various choices before<\/p>\n<p>them to opt for the specialized courses or even to opt for<\/p>\n<p>employment          through competitive exams.    This court        may<\/p>\n<p>also take judicious       notice   that usually these          exams are<\/p>\n<p>fixed on Sundays and public holidays as a matter of<\/p>\n<p>convenience. However, there is no centralized agency which<\/p>\n<p>fixes these exams for all the academic professional courses<\/p>\n<p>and even for the appointments or monitors that various<\/p>\n<p>exams are not scheduled on the same date . It is a matter of<\/p>\n<p>common knowledge that the students of different streams<\/p>\n<p>come to take the LLB entrance examination and it is possible<\/p>\n<p>that when opting to pursue such other professional or<\/p>\n<p>academic courses, they may get deprived and loose the<\/p>\n<p>opportunity to appear in many other competitive exams<\/p>\n<p><span class=\"hidden_text\">W.P.(C) 3403\/2011                                Page 6 of 7<\/span><br \/>\n because of clash of dates such as the civil services<\/p>\n<p>examinations. There is no dispute with the legal position<\/p>\n<p>canvassed by counsel for the petitioner that every citizen has<\/p>\n<p>a right to education and cannot be deprived of it but that<\/p>\n<p>cannot be construed so as to indulge the courts in declaring<\/p>\n<p>one exam important than the other and it is thus dangerous if<\/p>\n<p>the courts start interfering to upset the schedule fixed by the<\/p>\n<p>University      and    other   public   authorities    for   various<\/p>\n<p>competitive examinations.
