Justice S.SIRI JAGAN\n\n Dated :29\/08\/2008\n\n O R D E R\n                      S.SIRI JAGAN, J\n                ==================\n                 W.P(C)No.25897 of 2008\n                ==================\n         Dated this the 29th day of August, 2008.\n\n                      J U D G M E N T\n<\/pre>\n<p>     The petitioner is a company registered under the<\/p>\n<p>Companies Act, which is sponsored by the Government of<\/p>\n<p>Kerala. The company has been established with the assistance<\/p>\n<p>of the European Union with the object of improvement of<\/p>\n<p>horticulture production in the State by helping the farmers<\/p>\n<p>engaged in horticulture, which objects are pursued by the<\/p>\n<p>Company.    According to the petitioner,     theirs is a service<\/p>\n<p>organization and not a commercial establishment or factory.<\/p>\n<p>Their grievance is that in spite of the above facts the<\/p>\n<p>respondents have initiated proceedings under the Kerala<\/p>\n<p>Labour Welfare Fund Act to cover their establishment under<\/p>\n<p>that Act and to recover contributions under that Act.       The<\/p>\n<p>petitioner challenges the same on the ground that the<\/p>\n<p>petitioner is not an establishment as defined in the Kerala<\/p>\n<p>Labour Welfare Fund Act and therefore they are not liable to<\/p>\n<p>pay contribution under the Act.\n<\/p>\n<p>     2. I am of opinion that, the petitioner being a Government<\/p>\n<p>sponsored organization, the Government should first consider<\/p>\n<p><span class=\"hidden_text\">W.P(C)No.25897 of 2008         &#8211; 2 &#8211;<\/span><\/p>\n<p>the matter.       The petitioner has now submitted Ext.P8<\/p>\n<p>representation in this regard before the additional 4th<\/p>\n<p>respondent. In the above circumstances, I dispose of this writ<\/p>\n<p>petition with a direction to the additional 4th respondent,<\/p>\n<p>Government of Kerala to consider and pass appropriate orders<\/p>\n<p>on Ext.P8, as expeditiously as possible, at any rate, within three<\/p>\n<p>months from the date of receipt of a copy of this judgment<\/p>\n<p>after affording an opportunity of being heard to the petitioner.<\/p>\n<p>Till orders are thus passed further proceedings under the<\/p>\n<p>Labour Welfare Fund Act against the petitioner shall be kept in<\/p>\n<p>abeyance.\n<\/p>\n<p>     The petitioner shall forward a certified copy of this<\/p>\n<p>judgment along with a copy of the writ petition to the<\/p>\n<p>additional 4th respondent for compliance.<\/p>\n<p>                                       S.SIRI JAGAN, JUDGE<\/p>\n<p>rhs<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Vegetable And Fruit Promotion &#8230; vs The Labour Welfrare Fund &#8230; on 29 August, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 25897 of 2008(G) 1.
