Desai waives service of notice of Rule for the<br \/>\n\trespondent &#8211; State.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 438 of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered as<br \/>\n\tI-CR No.4\/2011 with Muli Police Station, Surendranagar for the<br \/>\n\toffences punishable under Sections 192, 196, 403, 406, 408, 409,<br \/>\n\t418, 420, 423, 465, 466, 467, 468, 470, 471, 474, 477(A), 120B and<br \/>\n\t114 of the Indian Penal Code.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the applicant places reliance on the order dated<br \/>\n\t22.02.2011 passed by this Court in Criminal Misc. Application<br \/>\n\tNo.1455 of 2011 wherein one of the Director against whom almost<br \/>\n\tsimilar allegations were levelled and after enquiry under Section 93<br \/>\n\tof the Gujarat Co-operative Societies Act, no irregularity was<br \/>\n\tfound.  It is further submitted that even if allegations in the FIR<br \/>\n\ttaken as they are, they are pertaining to the year 1998-1999 and<br \/>\n\tdecree was also passed by the Board of Nominees against which appeal<br \/>\n\tis pending.  The applicant is not likely to flee from the course of<br \/>\n\tjustice and considering the above facts, the applicant may be<br \/>\n\tgranted anticipatory bail.\n<\/p>\n<p>Heard<br \/>\n\tLearned APP Mr. Desai for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration all the above facts, I am<br \/>\n\tinclined to grant anticipatory bail to the applicant. This Court has<br \/>\n\talso taken into consideration the law laid down by the Apex Court in<br \/>\n\tthe case of <a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of<br \/>\n\tMaharashtra &amp; Ors. Reported<\/a> in [2011]1 SCC 694, wherein<br \/>\n\tthe Apex Court reiterated the law laid down by the Constitutional<br \/>\n\tBench in the case of Shri Gurubaksh Singh Sibbia &amp; Ors.<br \/>\n\tReported in [1980]2 SCC 565.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe result, this application is allowed by directing that in the<br \/>\n\tevent of the applicant herein being arrested pursuant to FIR being<br \/>\n\tI-CR No.4\/2011 with Muli Police Station, Surendranagar the applicant<br \/>\n\tshall be released on bail on furnishing a bond of Rs.10,000\/-<br \/>\n\t(Rupees Ten Thousand only) with one surety of like amount on<br \/>\n\tfollowing conditions :-\n<\/p>\n<p>\t[a]\tshall<br \/>\ncooperate with the investigation and make themselves available for<br \/>\ninterrogation whenever required.\n<\/p>\n<p>\t[b]\tshall<br \/>\nremain present at concerned Police Station on 26th<br \/>\nApril, 2011 between 11:00 am to 2:00 pm:\n<\/p>\n<p>\t[c]\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>\t[d]\tshall<br \/>\nat the time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>\t[e]<br \/>\n\twill not leave India without the permission of the Court and, if is<br \/>\nholding Passports, shall surrender the same before the trial Court<br \/>\nimmediately;\n<\/p>\n<p>\t[f]\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>\t[g]\tdespite<br \/>\nthis order, it would be open for the Investigating Agency to apply to<br \/>\nthe competent Magistrate, for police remand of the applicants. The<br \/>\napplicant shall remain present before the learned Magistrate on the<br \/>\nfirst date of hearing of such application and on all subsequent<br \/>\noccasions, as may be directed by the learned Magistrate. This would<br \/>\nbe sufficient to treat the accused in the judicial custody for the<br \/>\npurpose of entertaining application of the prosecution for police<br \/>\nremand. This is, however, without prejudice to the right of the<br \/>\naccused to seek stay against an order of remand, if ultimately<br \/>\ngranted, and the power of the learned Magistrate to consider such a<br \/>\nrequest in accordance with law. It is clarified that the applicant,<br \/>\neven if, remanded to the police custody, upon completion of such<br \/>\nperiod of police remand, shall be set free immediately, subject to<br \/>\nother conditions of this anticipatory bail order.\n<\/p>\n<p>Rule<br \/>\n\tmade absolute.
