JUSTICE KAILASH CHANDRA JOSHI\n\n\nMr.P.N.Mohnani for the petitioners.\nMr.A.R.Nikub, Public Prosecutor.\nMr.Ashok Chhangani for respondent No.2.\n\nBY THE COURT :<\/pre>\n<p>        The petitioners Dinesh Kumar Acharya     s\/o Parasram r\/o<\/p>\n<p>Nakas    Gate,    Behind Traffic Police Station, Nagaur and Pawan<\/p>\n<p>Acharya s\/o Narayan and Harish Acharya s\/o Parasram           have<\/p>\n<p>challenged the registration of a criminal case by way of FIR No.<\/p>\n<p>150\/2009 of Police station Nagaur and       further   investigation<\/p>\n<p>which is under way, for the offences under section 406 and 420<\/p>\n<p>IPC,    by       way of quashing the above FIR and         further<\/p>\n<p>investigation.\n<\/p>\n<p>       The facts leading to the present petition are as under:<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>      That the first information report         aforesaid     has been<\/p>\n<p>registered on a complaint made by the Assistant Engineer,<\/p>\n<p>Ajmer, Vidhyut Vitran Nigam Ltd., Nagaur (hereinafter referred<\/p>\n<p>to as &#8216;the Nigam&#8217;) stating that         a contract for      collection of<\/p>\n<p>electricity bills   was executed on 07.10.2005 in favour of the<\/p>\n<p>agency     as Jai Maa Electric      Labour     &amp; Contractor      Sahkari<\/p>\n<p>Samiti, Nagaur (hereinafter referred to as &#8216;the Samiti&#8217;), of which<\/p>\n<p>the petitioner No.1 Pawan Acharya            being its president     and<\/p>\n<p>Harish Acharya as being treasurer and Dinesh Acharya as being<\/p>\n<p>its Secretary,      who had   furnished the     requisite   undertaking<\/p>\n<p>that in terms of the work order it was incumbent            for the said<\/p>\n<p>Samiti to have deposited the collected amount of each day in<\/p>\n<p>the Bank account of the complainant           Nigam on the very day<\/p>\n<p>and to produce the receipts the next day in the Nigam Office and<\/p>\n<p>also to furnish the details of the payment received every day.<\/p>\n<p>      The complainant has alleged that          even while     collecting<\/p>\n<p>the payments the Samiti started          retaining    the counter foils<\/p>\n<p>and   stopped furnishing the details of the deposited amount to<\/p>\n<p>the Nigam according to the complainant by            23.03.09 the said<\/p>\n<p>collecting agency retained an amount of Rs. 26.77 lacs                as<\/p>\n<p>received from 2502 consumers . It was submitted by the<\/p>\n<p>complainant that the contract            with the Samiti has been<\/p>\n<p>discontinued but proceedings are required to be taken against<\/p>\n<p>the Samiti for       embezzlement       of money collected from the<\/p>\n<p>consumers and for cheating.\n<\/p>\n<p>      On the basis of above first information report, criminal<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>case No.150\/ 09.04.09 was registered at Police Station Nagaur<\/p>\n<p>and the investigation is pending.\n<\/p>\n<\/p>\n<p>      The learned counsel for the petitioners contended that as<\/p>\n<p>a matter of fact the membership of the petitioners in the said<\/p>\n<p>Samiti had been terminated way back in the months of April and<\/p>\n<p>May 2007 and       the facts had also been        recorded in the<\/p>\n<p>concerned register of the      Registered Cooperative Societies to<\/p>\n<p>the effect that there had been handing over and taking over of<\/p>\n<p>charges of the newly constituted Samiti          on 20.05.07 and,<\/p>\n<p>therefore, the present petitioners    have no concern with the said<\/p>\n<p>collection agency. It is also submitted that the amount referred<\/p>\n<p>in the first information report relates to the months of December<\/p>\n<p>2008 to March 2009 i.e. which is of after the termination of the<\/p>\n<p>membership of the petitioners with the said Samiti and hence<\/p>\n<p>the investigation in the above criminal case cannot be continued<\/p>\n<p>and is liable to be quashed.\n<\/p>\n<\/p>\n<p>      Per contra, the learned counsel for the respondents<\/p>\n<p>contended that the investigation in the above matter is pending<\/p>\n<p>and the necessary documents are required to be produced by<\/p>\n<p>the petitioners.\n<\/p>\n<\/p>\n<p>       During the course of arguments           it has also been<\/p>\n<p>contended by the learned counsel for the petitioners that later on<\/p>\n<p>Assistant Engineer of the Nigam filed a civil suit for the recovery<\/p>\n<p>of the said amount in the competent court, that further weakens<\/p>\n<p>the investigation process in the criminal case. A copy of the<br \/>\n<span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>plaint has been submitted for perusal.\n<\/p>\n<\/p>\n<p>        The learned counsel for the petitioners, while arguing his<\/p>\n<p>case, relied on the following decisions :-\n<\/p>\n<\/p>\n<blockquote><p>    1. <a href=\"\/doc\/678316\/\">B.Suresh Yadav vs. Sharifa Bee<\/a> [2005 Cr.L.J. 431]<\/p>\n<blockquote><p>    2. <a href=\"\/doc\/48782340\/\">Vir Prakash Sharma vs. Anil Kumar Agarwal<\/a> [( 2007) 7<br \/>\n       SCC 373] and<\/p>\n<\/blockquote>\n<blockquote><p>    3. <a href=\"\/doc\/1756347\/\">All Cargo Movers (I) Pvt.Ltd. vs. Dhanesh Badarmal Jain &amp;<br \/>\n       Anr.<\/a>[2007 AIR SCW 6667]<\/p>\n<p>        Learned counsel for the respondent        on the other hand ,<\/p>\n<p>while      advancing   his   argument    relied    on   the   following<\/p>\n<p>judgments :-\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>    1. Mohd. Ibrahim vs. State of Bihar [(2009)8 SCC 751]<\/p>\n<\/blockquote>\n<blockquote><p>    2. Jimmy Sudarshan Purohit vs. Sudarshan Sharad Purohit<br \/>\n       [(2005) 13 SCC 410]<\/p>\n<\/blockquote>\n<blockquote><p>    3. <a href=\"\/doc\/293053\/\">Sunita Jain vs. Pawan Kumar Jain<\/a> [(2008) 2 SCC 705]<\/p>\n<\/blockquote>\n<blockquote><p>    4. <a href=\"\/doc\/1967566\/\">State of Maharashtra vs. Sayed Mohammed Masood<\/a><br \/>\n      [(2009) 8 SCC 787]<\/p>\n<\/blockquote>\n<blockquote><p>    5. <a href=\"\/doc\/1126288\/\">Central Bureau of Investigation vs. K.M. Sharan<\/a> [ (2008)<br \/>\n      4 SCC 471] and<\/p>\n<\/blockquote>\n<blockquote><p>    6. <a href=\"\/doc\/1446370\/\">Pratibha vs. Rameshwari Devi<\/a> [( 2007) 12 SCC 369]<\/p>\n<p>        I have gone through the judgments cited by the learned<\/p>\n<p>counsel for    both the parties and also perused the copy of the<\/p>\n<p>plaint filed by the learned counsel for the petitioners.<\/p><\/blockquote>\n<\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>        The contours of the power under section 482 Cr.P.C. have<\/p>\n<p>been explained in a series of decisions by the <a href=\"\/doc\/1033637\/\">Hon&#8217;ble Supreme<\/p>\n<p>Court. In State of Haryana        vs. Bhajan Lal<\/a> [1992 Supp (1)<br \/>\n<span class=\"hidden_text\">                                 5<\/span><\/p>\n<p>SCC 335]     a question came up for consideration as to whether<\/p>\n<p>the quashing of the FIR filed against the respondent Bhajan Lal<\/p>\n<p>for the offence under section 161 and 165 IPC and section 5 (2)<\/p>\n<p>of the Prevention of Corruption Act was       proper and legal ?<\/p>\n<\/blockquote>\n<p>Reversing the     order passed by the High Court the Hon&#8217;ble<\/p>\n<p>Supreme Court explained the circumstances under which such<\/p>\n<p>power     could be exercised. Apart from    reiterating the earlier<\/p>\n<p>norms laid down by the Hon&#8217;ble Supreme Court, it was further<\/p>\n<p>explained that such power could be exercised where allegation<\/p>\n<p>made in the FIR or complaint are        so absurd and      innocently<\/p>\n<p>improbable, on the basis of which no prudent person can ever<\/p>\n<p>reach a just conclusion that there is sufficient ground for<\/p>\n<p>proceeding against      the accused. No doubt at the state of<\/p>\n<p>quashing the FIR or complaint the High Court is not justified in<\/p>\n<p>embarking upon an enquiry as to the probability, reliability or<\/p>\n<p>genuineness of the allegation made therein.<\/p>\n<p>      It is not unusual \/ unbecoming that an incident may give<\/p>\n<p>rise to   a cause of action   for the   civil as well as     criminal<\/p>\n<p>proceedings at a time. Institution of civil proceedings in such a<\/p>\n<p>case does not    distract or take away remedy of criminal       side.<\/p>\n<p>The fact that accused     petitioners were authorised to collect<\/p>\n<p>payment against the bills only up to certain period, cannot be<\/p>\n<p>disbelieved at this stage. Even if it is assumed that there was<\/p>\n<p>some express or implied consent for      extension of the term of<\/p>\n<p>contract, still withholding the collection for unduly long period<\/p>\n<p>in violation of the conditions of the contract and further without<\/p>\n<p>satisfactory explanation may lead to an inference of dishonesty<br \/>\n<span class=\"hidden_text\">                                  6<\/span><\/p>\n<p>and the result of the investigation    only will establish the true<\/p>\n<p>nature of the dispute i.e. whether it is pure civil dispute or some<\/p>\n<p>criminal intent was there behind it.\n<\/p>\n<\/p>\n<p>      Quashing of first information report at investigation stage<\/p>\n<p>is possible only in a rarest of the rare cases where it suffers from<\/p>\n<p>some inherent improbability or even if      accepted    on its face<\/p>\n<p>value , will not constitute any offence or whether investigation<\/p>\n<p>itself is patently barred by law. The case in hand is not of such a<\/p>\n<p>nature so as to call for interference at this stage, in view of the<\/p>\n<p>provisions enunciated by the Hon&#8217;ble Supreme Court in the case<\/p>\n<p>of <a href=\"\/doc\/1033637\/\">State   Haryana    vs. Bhajan Lal<\/a> (supra).\n<\/p>\n<\/p>\n<p>      In   B.Suresh Yadav &#8216;s case (supra) the Hon&#8217;ble apex court<\/p>\n<p>found no dishonest concealment of facts and two contrary and<\/p>\n<p>inconsistent stand were taken by the complainant.<\/p>\n<p>      In    Vir Prakash Sharma&#8217;s case (supra) the Hon&#8217;ble<\/p>\n<p>Supreme Court held that     non payment or unpayment of price<\/p>\n<p>of goods by itself does not amount to cheating or breach of trust<\/p>\n<p>and it had to be essentially a civil dispute.\n<\/p>\n<\/p>\n<p>      In   All Cargo Movers (I) Pvt. Ltd.&#8217;s case (supra)        the<\/p>\n<p>Hon&#8217;ble Supreme Court held that breach of contract simplicitor<\/p>\n<p>does not constitute an offence and the criminal complaint was<\/p>\n<p>filed after one year of filing the civil suit. The Hon&#8217;ble Supreme<\/p>\n<p>Court quashed the criminal proceedings.\n<\/p>\n<p><span class=\"hidden_text\">                                      7<\/span><\/p>\n<p>           The facts of the present case are different. In the present<\/p>\n<p>case, the amount was collected by the Samiti on behalf of the<\/p>\n<p>Nigam from the consumers and they were not entitled to retain<\/p>\n<p>or keep the amount           collected   on behalf of the Nigam with<\/p>\n<p>them for such a long period. Therefore,in view of the principles<\/p>\n<p>enunciated by the Supreme Court in           State of Haryana&#8217;s case<\/p>\n<p>(supra) the present case is not of such a nature so as to call<\/p>\n<p>for interference at this stage under section 482       Cr.P.C.<\/p>\n<p>           SB Cri.Misc. Petition No.186\/2010 filed by Dinesh Kumar<\/p>\n<p>Acharya and         SB Cri.Misc.
