SAHAI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 14\/02\/2011 \n\n \n\n \n \nCOMMON\nORAL ORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.L.DAVE)<\/p>\n<p>1.\tHeard<br \/>\nlearned advocate Mr.Thomas for Mr.Vibhuti Nanavati.  He states in<br \/>\nsupport of these applications that, the applicant may be directed to<br \/>\ndeposit the decretal amount with the trial Court, instead of Bank<br \/>\nGuarantee.\n<\/p>\n<p>2.\tThe<br \/>\nmajor aspects emerge that, (i) this Court never granted interim<br \/>\nrelief on condition of the applicant&#8217;s furnishing Bank Guarantee;\n<\/p>\n<p>(ii) it does not appear that the applicant has approached the trial<br \/>\nCourt with a request to accept the decretal amount in cash and<br \/>\ninstead of furnishing security; and (iii) there is no order produced<br \/>\non record of this Court to show that the Court is demanding the Bank<br \/>\nGuarantee.\n<\/p>\n<p>3.\tThe<br \/>\napplications, therefore,  are ill-founded and frivolous and rejected<br \/>\nwith cost of Rs.5,000\/- each, i.e. total Rs.10,000\/- to be deposited<br \/>\nwithin two weeks in the Registry of this Court.
