Justice KURIAN JOSEPH\n\n Dated :22\/06\/2007\n\n O R D E R\n                            KURIAN JOSEPH, J.\n\n                 -----------------------------------------\n\n                          O.P.No. 2698 of  1997\n\n                 -----------------------------------------\n\n               Dated this the 22nd day of  June, 2007\n\n\n                                     JUDGMENT\n<\/pre>\n<p>      The   writ   petition   is   filed   aggrieved   by   Exts.P2   and   P4<\/p>\n<p>proceedings   initiated   under   the   provisions   of   the   Kerala<\/p>\n<p>Scheduled   Tribes   (Restriction   on   Transfer   of   Lands   and<\/p>\n<p>Restoration of Alienated Lands) Act, 1975 whereby the petitioner<\/p>\n<p>was directed to surrender an extent of 28&gt; cents of property to<\/p>\n<p>the original vendors who are members of the Scheduled Tribe, on<\/p>\n<p>the ground that the same is hit by the restrictions on transfer of<\/p>\n<p>such   lands   by   members   belonging   to   Scheduled   Tribe.     The<\/p>\n<p>property is purchased during the period 1973 to 1983.  In view of<\/p>\n<p>the recent enactment &#8211; The Kerala Restriction on Transfer by and<\/p>\n<p>Restoration of Lands to Scheduled Tribes Act, 1999 the petitioner<\/p>\n<p>is   entitled   to   succeed   since   such   transfers   of   small   extents   are<\/p>\n<p>protected by proviso to Section 5 of the Act.   Section 5 reads as<\/p>\n<p>follows:-\n<\/p>\n<blockquote><p>                            &#8220;5.        Certain   transfers   to   be   invalid.-(1)<\/p>\n<p>                     Notwithstanding anything to the contrary contained in any<\/p>\n<p>                     other law for the time being in force, or in any contract,<\/p>\n<p>                     custom or usage, or in any judgment, decree or order of<\/p>\n<p>                     any   Court,   any   transfer   of   land   possessed,   enjoyed   or<\/p>\n<p>OP NO.2698\/1997<\/p>\n<p><span class=\"hidden_text\">                                         -:2:-<\/span><\/p>\n<p>                    owned   by   a   member   of   a   Scheduled   Tribe   to   a   person<\/p>\n<p>                    other than a member of a Scheduled Tribe, effected on or<\/p>\n<p>                    after   the   1st  day   of   January,   1960,   and   before   the<\/p>\n<p>                    commencement of this Act shall be deemed to be invalid:<\/p>\n<\/blockquote>\n<blockquote><p>                           Provided   that   nothing   in   this   section   shall   render<\/p>\n<p>                    invalid any transfer of land possessed, enjoyed or owned<\/p>\n<p>                    by a member of a Scheduled Tribe to a person other than<\/p>\n<p>                    a   member   of   a   Scheduled   Tribe   effected   during   the<\/p>\n<p>                    aforesaid period and the extent of which does not exceed<\/p>\n<p>                    two hectares.&#8221;\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>        2.    The  extent  as  already  noted  above   is   only   28&gt;  cents.<\/p>\n<\/blockquote>\n<p>The   transfer   is   between   1973   to   1983.     Thus   the   petitioner   is<\/p>\n<p>entitled   to   succeed   in   view   of   the   proviso   quoted   above.
