Justice M.SASIDHARAN NAMBIAR\n\n Dated :07\/07\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n             CRL.R.P.NO.666 OF 2001\n           ---------------------------------------------\n                Dated 7th July, 2010\n\n\n                          O R D E R\n<\/pre>\n<p>             Petitioner               was        convicted   and<\/p>\n<p>sentenced for the offence under Section 55<\/p>\n<p>(g) of Abkari Act by Judicial First Class<\/p>\n<p>Magistrate-II,                   Thamarassery                  in<\/p>\n<p>C.C.275\/1997. Though petitioner challenged<\/p>\n<p>the conviction and sentence before Sessions<\/p>\n<p>court, Kozhikode in Crl.A.355\/1998, learned<\/p>\n<p>Additional      Sessions                 Judge           on  re-<\/p>\n<p>appreciation     of        evidence              confirmed   the<\/p>\n<p>conviction and sentence and dismissed the<\/p>\n<p>appeal. It is      challenged in the revision.<\/p>\n<p>       2.     Learned             counsel appearing for<\/p>\n<p>the   petitioner              and           learned        Public<\/p>\n<p>Prosecutor  were heard.\n<\/p>\n<p>       3.     Learned             counsel appearing for<\/p>\n<p>CRRP 666\/01<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>the      petitioner submitted that though in the<\/p>\n<p>light of evidence, conviction for the offence<\/p>\n<p>under Section 55(g) of Abkari Act is to be<\/p>\n<p>confirmed,     petitioner  is  entitled  to   the<\/p>\n<p>benefit     of   the  benevolent  provisions   of<\/p>\n<p>Probation of Offenders Act. It is submitted<\/p>\n<p>that petitioner was being treated for mental<\/p>\n<p>illness and in such circumstances, it is not in<\/p>\n<p>the    interest   of  justice  to  direct     the<\/p>\n<p>petitioner to undergo      imprisonment.  It was<\/p>\n<p>pointed     out   that  though  when  prosecution<\/p>\n<p>witnesses were cross examined, though it was<\/p>\n<p>not      pointed   out,   when   petitioner   was<\/p>\n<p>questioned     under  Section  313  of  Code   of<\/p>\n<p>Criminal Procedure, it was stated by him that<\/p>\n<p>he was undergoing treatment for mental illness<\/p>\n<p>and    learned Magistrate did not accept the said<\/p>\n<p>defence    as  materials  were not  produced  and<\/p>\n<p>CRRP 666\/01<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>before     the  appellate   court,  petitioner   had<\/p>\n<p>produced records to prove that he was          being<\/p>\n<p>treated for mental illness but learned       Sessions<\/p>\n<p>Judge      did not accept them finding that it was<\/p>\n<p>obtained only subsequent to the seizure of the<\/p>\n<p>contraband article and not prior to or at the time<\/p>\n<p>of seizure. Learned counsel submitted that in such<\/p>\n<p>circumstances, a report was called for by this<\/p>\n<p>court from District Probation Officer, Kozhikode<\/p>\n<p>and   the    report  discloses that  petitioner   was<\/p>\n<p>undergoing treatment at Institute of Mental Health<\/p>\n<p>and Neuro Sciences, Kozhikode and though illness is<\/p>\n<p>under     control,  he   does  not   understand   the<\/p>\n<p>consequence of his acts and    in such circumstances,<\/p>\n<p>petitioner    is   to  be  granted  the  benefit   of<\/p>\n<p>probation of Offenders Act.\n<\/p>\n<p>           4.  Report submitted by District Probation<\/p>\n<p>Officer, Kozhikode before this court, reveals that<\/p>\n<p>petitioner    was  treated  at  Institute  of  Mental<\/p>\n<p>Health      and   Neuro   science,   Kozhikode    for<\/p>\n<p>CRRP 666\/01<br \/>\n<span class=\"hidden_text\">                         4<\/span><\/p>\n<p>Sehizopharnia   and though  illness  is  now  under<\/p>\n<p>control, he is not in a position to work and is not<\/p>\n<p>even follow what others say. District Probation<\/p>\n<p>Officer has also reported that his father is no<\/p>\n<p>more. Mother is aged. Petitioner has a wife and<\/p>\n<p>children. The wife is also suffering from illness.<\/p>\n<p>It is reported that his mother, wife   and children<\/p>\n<p>are fond of him and they take care of him and it is<\/p>\n<p>a fit case to grant the benefit of benevolent<\/p>\n<p>provisions of Probation of offenders Act.<\/p>\n<p>           5. Abkari   Act   does    not   exclude<\/p>\n<p>applicability of Probation of offenders Act.<\/p>\n<p>This court in <a href=\"\/doc\/1485559\/\">Ammini v. State of Kerala<\/a> (1981<\/p>\n<p>KLT SN Case No.50, Page 28) considered the<\/p>\n<p>question of applying      Probation of Offenders<\/p>\n<p>Act to an accused of an offence under the<\/p>\n<p>Abkari Act. Holding that Abkari Act does not<\/p>\n<p>contain      any provision    prohibiting use of<\/p>\n<p>Probation    of  Offenders Act   to  an  offender,<\/p>\n<p>CRRP 666\/01<br \/>\n<span class=\"hidden_text\">                          5<\/span><\/p>\n<p>convicted under Section 55 of the Act, it was<\/p>\n<p>cautioned that considering the fact that the<\/p>\n<p>offence is not only involve revenue of the<\/p>\n<p>State     but also to the public health,   it must<\/p>\n<p>be in the mind of the court, when assessing<\/p>\n<p>whether probation treatment could be given to a<\/p>\n<p>particular offender.\n<\/p>\n<p>           6.     The  punishment provided  for an<\/p>\n<p>offence under section 55(g) of the Abkari Act,<\/p>\n<p>prior to 3.6.1997, was imprisonment for a term<\/p>\n<p>which may extend to two years and a fine of not<\/p>\n<p>less than Rs.25,000\/-.    Considering the fact that<\/p>\n<p>petitioner is a schizophrenia patient and      the<\/p>\n<p>report submitted by the District Probation Officer,<\/p>\n<p>Kozhikode, it is not in the interest of justice to<\/p>\n<p>send     the  petitioner  to   prison  to   undergo<\/p>\n<p>imprisonment. Instead   petitioner could be granted<\/p>\n<p>the benefit as provided under section 4 of the<\/p>\n<p>Probation of Offenders Act.\n<\/p>\n<p>CRRP 666\/01<br \/>\n<span class=\"hidden_text\">                           6<\/span><\/p>\n<p>           Revision is allowed in part.    Conviction<\/p>\n<p>of the petitioner for the offence under section 55<\/p>\n<p>(g) of the Abkari Act is confirmed.     The sentence<\/p>\n<p>is set aside. Petitioner is granted the benefit of<\/p>\n<p>Probation of Offenders Act.     Judicial First Class<\/p>\n<p>Magistrate-II, Thamrasserry    is directed to release<\/p>\n<p>the petitioner on probation of good conduct on<\/p>\n<p>executing a bond for Rs.5000\/-, with two solvent<\/p>\n<p>sureties, to appear and receive the sentence as and<\/p>\n<p>when called upon, during a period of three years,<\/p>\n<p>and to keep peace during that period.      Petitioner<\/p>\n<p>is directed to appear before Judicial First Class<\/p>\n<p>Magistrate, Thamarasserry and execute the bond, on<\/p>\n<p>12.8.2010.
