The background facts which are absolutely necessary and germane for the<br \/>\ndisposal of this criminal revision case would run thus:\n<\/p>\n<p>\tC.C.Nos.156 and 157 of 2004 emerged on the file of the learned Judicial<br \/>\nMagistrate No.I, Virudhunagar.  After conducting separate trials, he pronounced<br \/>\nseparate judgments on the one and the same day imposing sentences as under:\n<\/p>\n<p>S.No.\n<\/p>\n<p>C.C.No.<\/p>\n<pre>\nConviction Recorded\nSentence     Imposed\n<span class=\"hidden_text\">1<\/span>\nC.C.No.156 of 2004\nU\/s. 138 of the Negotiable Instruments Act.\n<\/pre>\n<p>To undergo one year rigorous imprisonment and to pay a fine of Rs.5,000\/- in<br \/>\ndefault to undergo three months simple imprisonment.\n<\/p>\n<p><span class=\"hidden_text\">1<\/span><\/p>\n<p>C.C.No.157 of 2004<br \/>\nU\/s. 138 of the Negotiable Instruments Act.\n<\/p>\n<p>To undergo one year rigorous imprisonment and to pay a fine of Rs.5,000\/- in<br \/>\ndefault to undergo three months simple imprisonment.\n<\/p>\n<p>\t3. Being aggrieved by and dissatisfied with, such convictions, they<br \/>\npreferred appeals before the Additional Sessions Judge, Fast Track Court,<br \/>\nVirudhunagar and the  appellate Court also confirmed the convictions recorded<br \/>\nand the sentence imposed by the learned Magistrate.\n<\/p>\n<p>\t4. As against which, the accused preferred these Criminal Revision Cases.\n<\/p>\n<p>\t5. The learned Counsel for the petitioner, while arguing the revisions,<br \/>\nrestricted his argument only to the extent that the sentences imposed in both<br \/>\nthe cases may be ordered to run concurrently.\n<\/p>\n<p>\t6. Heard the learned Counsel for the complainant also who would submit<br \/>\nthat for each case, two years substantive sentence of imprisonment is<br \/>\ncontemplated and the learned Magistrate was kind enough in imposing one year in<br \/>\neach case and further leniency in this regard may not be tenable.\n<\/p>\n<p>\t7. The learned Counsel for the complainant would also air the grievance of<br \/>\nthe complainant that the total amount involved in this matter is Rs.16,25,000\/-<br \/>\n(Rupees Sixteen Lakhs and Twenty Five Thousand only).\n<\/p>\n<p>\t8. Be that as it may, here, on the one and the same day, both the<br \/>\njudgments were pronounced for the offence punishable under Section 138 of the<br \/>\nNegotiable Instruments Act.  A mere analysis of sentencing pattern that is<br \/>\nprevailing in India is considered, would at once make it crystal clear that as a<br \/>\nrule ordering concurrent sentences is a normal factor rather than awarding<br \/>\nconsecutive sentences.  If at all, any special circumstance is involved, in such<br \/>\ncases alone, the Courts have ordered sentences to run consecutively.\n<\/p>\n<p>\t9. Here, the offences in both the matters are under Section 138 of the<br \/>\nNegotiable Instruments Act, committed by one and the same accused as against the<br \/>\none and the same complainant and in such a case, I am of the considered opinion<br \/>\nthat awarding concurrent sentences would meet the ends of justice irrespective<br \/>\nof the fact whether the amount involved was Rs.16,25,000\/-(Rupees Sixteen Lakhs<br \/>\nand Twenty Five Thousand only).  Accordingly, I am of the opinion that each of<br \/>\nthe above substantive sentences of imprisonment imposed on the petitioner shall<br \/>\nrun concurrently and no other variation is ordered.\n<\/p>\n<p>\t10.
