Single<br \/>\nJudge in Special Civil Application No. 7659\/2010, whereby the Ld.<br \/>\nSingle Judge has dismissed the petition.\n<\/p>\n<p>2.\t\tWe have heard Mr.<br \/>\nShalin Mehta, learned counsel appearing with Ms. Vidhi Bhatt for the<br \/>\nappellant.\n<\/p>\n<p>3.\t\tThe contention<br \/>\nraised on behalf of the appellant is that earlier Special Civil<br \/>\nApplication No. 11051\/2001 was not pressed with a view to make<br \/>\nrepresentation and, therefore, the said ground should not disentitle<br \/>\nthe petitioner to challenge the decision taken after the<br \/>\nrepresentation. It was also submitted that the Ld. Single Judge ought<br \/>\nto have examined the merits of the matter as to whether the decision<br \/>\nof the authority was legal or not.  When we called upon the learned<br \/>\ncounsel appearing for the appellant to address us on the merits of<br \/>\nthe main Special Civil Application, it was contended that as per the<br \/>\nGovernment Resolution dated 1\/5\/2007 representation was made to<br \/>\nabsorb the petitioner as permanent and as the authority have<br \/>\ndeclined, the main Special Civil Application was preferred.  It was<br \/>\nsubmitted that there are two grounds in the impugned order of the<br \/>\nauthority to reject the representation, one is that no relaxation is<br \/>\npermissible and another is that the set-up is not available. He<br \/>\nsubmitted that as per the information obtained under the Rights To<br \/>\nInformation Act, the posts were available. So far as the relaxation<br \/>\nin the resolution is concerned, it is submitted that the petitioner<br \/>\nis covered by the resolution and, therefore, there was no question of<br \/>\nrelaxation and hence, on merits, the impugned order of the authority<br \/>\ncould not stand in the eye of law.\n<\/p>\n<p>4.\t\tOn the merits of the<br \/>\nSpecial Civil Application, it appears to us that the basis of the<br \/>\nrepresentation was Government Resolution dated 1\/5\/2007. As per the<br \/>\nsaid Resolution, copy whereof is produced in the compilation of the<br \/>\nSpecial Civil Application, the resolution was only  by way of &#8220;one<br \/>\ntime measure&#8221; and it was<br \/>\nnot to operate continuously. The pertinent aspect is that at the time<br \/>\nwhen the Resolution dated 1\/5\/2007 was passed, the original<br \/>\npetitioner was not in service and he came to be terminated as back as<br \/>\non 30\/11\/2001. Further there was no interim order in the earlier<br \/>\nSpecial Civil Application No. 11051\/2001, pursuant to which the<br \/>\npetitioner continued in<br \/>\nservice.\n<\/p>\n<p>5.\t\tApart from the<br \/>\nabove, as per the Resolution, the requirement was that the person<br \/>\nconcerned should have been in service as part timer on 10\/2\/2006 and<br \/>\nhe should have completed 10 years of service as part timer. Even if<br \/>\none considers service period of the petitioner as part timer from<br \/>\n3\/7\/1990 to 30\/11\/2001, the second condition in service on 10\/2\/2006<br \/>\nwas not satisfied. Therefore, the authority rightly observed that the<br \/>\nrelaxation in the resolution was not permissible. If the petitioner<br \/>\nwas not fulfilling the requirements as per the Resolution for<br \/>\nabsorption   in the permanent post, the aspect of whether the post<br \/>\nwas available or not would not be of much relevance. Under these<br \/>\ncircumstances, we find that on merits, there was no case for<br \/>\ninterference, in the petition.\n<\/p>\n<p>6.\t\tIn<br \/>\nview of the aforesaid observations, on merits of the main Special<br \/>\nCivil Application, we find<br \/>\nthat no useful purpose would be served in interfering with the order<br \/>\npassed by the Ld. Single Judge, merely because the merits of the main<br \/>\nSpecial Civil Application were not considered, more particularly when<br \/>\nthe ultimate decision for dismissal of the Special Civil Application<br \/>\nwould stand even after the merits is considered.\n<\/p>\n<p>7.\t\tIn view of the<br \/>\naforesaid, we find that no interference deserves to be made to the<br \/>\nultimate decision taken by the Ld. Single Judge for dismissal of the<br \/>\npetition. Hence, the appeal is dismissed. No order as to costs.\n<\/p>\n<p>[<br \/>\nJAYANT PATEL, J. ]<\/p>\n<p>[<br \/>\nJ.C.
