SHAH\n\t\t\n\t\n\n \n\nDate\n: 13\/11\/2008 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tRule.\n<\/p>\n<p>Shri Amit Patel, learned AGP, waives service of notice of rule on<br \/>\nbehalf of the respondent. With the consent of the learned advocates<br \/>\nfor the respective parties, the matter is taken up for final hearing.\n<\/p>\n<p>2.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\nthe petitioner has prayed for an appropriate writ, direction and\/ or<br \/>\norder quashing and setting aside the impugned order passed by the<br \/>\nlearned Civil Judge (S.D.) Rajkot in Civil Miscellaneous Application<br \/>\nNo. 602 of 2006 in not condoning the delay of  7.5 months (seven and<br \/>\nhalf months)in preferring the application for restoration.\n<\/p>\n<p>3.\tIt<br \/>\nappears that petitioner herein original plaintiff had instituted the<br \/>\nsuit before the learned trial Court for declaration and permanent<br \/>\ninjunction challenging his termination. The said suit came to be<br \/>\ndismissed for non-prosecution on 14.10.2005 neither the petitioner<br \/>\nnor the learned advocate for the petitioner has remained present<br \/>\nbefore the learned trial Court. Thereafter, the petitioner submitted<br \/>\nthe application for restoration of the said suit, however as there<br \/>\nwas a delay of 7.5 months (seven and half months) in preferring the<br \/>\nsaid application for restoration, the petitioner submitted the<br \/>\napplication to condone the delay of 7.5 months (seven and half<br \/>\nmonths) and prayed to condone the delay, which came to be dismissed<br \/>\nby the learned trial by impugned order. Being aggrieved and<br \/>\ndissatisfied with the impugned order, the petitioner-plaintiff has<br \/>\npreferred the present Special Civil Application under Article 227 of<br \/>\nthe Constitution of India.\n<\/p>\n<p>4.\tShri<br \/>\nBavesh Rayani, learned advocate for the petitioner has submitted that<br \/>\nlearned trial Court has taken a too technical view in not condoning<br \/>\nthe delay and more particularly, there are no allegations that the<br \/>\nRestoration Application was not submitted by the petitioner with a<br \/>\nmala-fide intention and deliberately to delay the proceedings. It is<br \/>\nsubmitted that as held by the Hon&#8217;ble Supreme Court in catena of<br \/>\ndecisions, the delay should be construed liberally and even on<br \/>\nimposition of certain costs the learned trial Court ought to have<br \/>\ncondoned the delay in preferring the restoration application,<br \/>\ntherefore it is requested to allow the present Special Civil<br \/>\nApplication.\n<\/p>\n<p>5.\tShri<br \/>\nAmit Patel, learned AGP, while passing the impugned order has<br \/>\nsubmitted that the petitioner and \/or his advocate has remained<br \/>\nnegligent and it was a suit of 1991 and still in the year 2005<br \/>\nneither the petitioner nor the learned advocate has remained present<br \/>\nin 2005, therefore, learned trial Court was justified in dismissing<br \/>\nthe suit for non-prosecution. It is submitted that no sufficient<br \/>\ncause has been made out to condone the delay of 7.5 months (seven and<br \/>\nhalf months), therefore, it is requested to dismiss the present<br \/>\nSpecial Civil Application.\n<\/p>\n<p>6.\tHeard<br \/>\nthe learned advocates for the respective parties. It appears that on<br \/>\n14.10.2005 neither the petitioner nor his advocate has remain present<br \/>\n     before the learned trial Court, suit came to be dismissed for<br \/>\nnon-prosecution. It is the case on behalf of the petitioner that his<br \/>\nadvocate did not inform to the petitioner with respect to the<br \/>\ndismissal of the aforesaid suit and as soon as he came to know about<br \/>\nthe same, he has preferred application for restoration and by that<br \/>\ntime there was a delay of 7.5 months (seven and half months),<br \/>\ntherefore, considering the above, the learned trial Court ought to<br \/>\nhave condoned the delay. It is required to be noted that there are no<br \/>\nallegations that the petitioner has deliberately not filed the<br \/>\nrestoration application within the period of limitation and \/ or with<br \/>\na mala-fide intention, the application was not submitted within the<br \/>\nperiod of limitation. As held by the Hon&#8217;ble Supreme Court as well as<br \/>\nthis Court in catena of decisions normally sufficient cause should be<br \/>\nconstrued liberally and opportunity should be given to the parties to<br \/>\nsubmit their case on merits rather than non-suiting the suit on<br \/>\ntechnical ground. Under the circumstances, it appears to the Court on<br \/>\nimposing reasonable cost, the learned trial Court ought to have<br \/>\ncondoned the delay in preferring the restoration application. Under<br \/>\nthe circumstances, impugned order deserves to be quashed and set<br \/>\naside and delay in preferring the restoration application deserves to<br \/>\nbe condoned on the imposing the cost upon the petitioner which is<br \/>\nquantified at Rs. 2500\/- and petitioner shall deposit the same within<br \/>\na period of two months from today with the trial Court.\n<\/p>\n<p>7.\tFor<br \/>\nthe reasons stated above, petition succeeds and the impugned order<br \/>\npassed by the learned Civil Judge (S.D.) Rajkot in Civil<br \/>\nMiscellaneous Application No. 602 of 2006 in not condoning the delay<br \/>\nof  7.5 months (seven and half months)in preferring the application<br \/>\nfor restoration is hereby quashed and set aside and delay in<br \/>\npreferring the restoration application is hereby condoned on<br \/>\ncondition that the petitioner shall deposit Rs. 2500\/- with the trial<br \/>\nCourt within a period of two months from today and on such deposit<br \/>\nthe respondent shall be permitted to withdraw the same. On such<br \/>\ndeposit the delay is to be treated to have been condoned and the<br \/>\nlearned trial Court to decide and dispose of the restoration<br \/>\napplication only thereafter. If the amount of Rs. 2500\/- as ordered<br \/>\nearlier is not deposited by the petitioner within a period of 2<br \/>\nmonths, the order passed by the learned trial Court impugned in the<br \/>\npresent petition will stand. Rule is made absolute.
