Ramachandran Nair, J.\n                    - - - - - - - - - - - - - - - - - - - - - - - -\n                      W.P.(C) No. 24700 of 2009-F\n                    - - - - -- - - - - - - - - - - - - - - - - - - - -\n              Dated this the 28th day of January, 2010.\n\n                                  JUDGMENT\n<\/pre>\n<p>      The petitioner is aggrieved by the grant of NOC by the District<\/p>\n<p>Collector to the third respondent to establish a petroleum outlet in respect<\/p>\n<p>of the property in resurvey No.499\/12 and 499\/10 in Block No.38 of<\/p>\n<p>Vellanad Village, Nedumangad Taluk.                The allegation raised by the<\/p>\n<p>petitioner is that the third respondent is having only 17.5 cents of land and<\/p>\n<p>what is required is a minimum of 20 cents and the NOC has been issued in<\/p>\n<p>respect of the property byincluding adjoining puramboke land.                  The<\/p>\n<p>petitioner seeks for a direction to the District Collector to enquire into the<\/p>\n<p>matter in the light of Exts.P1 and P2 judgments.                      Ext.P3 is the<\/p>\n<p>representation submitted by the petitioner in this regard.<\/p>\n<p>      2. Learned Govt. Pleader on instructions, submitted that the matter is<\/p>\n<p>now in seisin of the first respondent and due enquiry is being conducted.<\/p>\n<p>He further submits that appropriate orders will be passed within a period of<\/p>\n<p>one month.\n<\/p>\n<p>      3. Therefore, there will be a direction to the first respondent to<\/p>\n<p>complete the enquiry already initiated in the matter and after hearing the<\/p>\n<p><span class=\"hidden_text\">wpc24700 \/2009                        2<\/span><\/p>\n<p>petitioner and the third respondent, a decision will be taken and the same<\/p>\n<p>will be communicated to the parties.\n<\/p>\n<p>      The writ petition is disposed of as above.
