M.S.SHAH)<\/p>\n<p>\tWithout<br \/>\ngoing into the question whether this Letters Patent Appeal is<br \/>\nmaintainable, otherwise also, the Appeal deserves to be dismissed, as<br \/>\nthe contentions sought to be raised in this Appeal were already<br \/>\nraised earlier in Civil Revision Application No.1139 of 1986, which<br \/>\ncame to be dismissed by a learned Single Judge by judgment dated<br \/>\n17.10.2002.\n<\/p>\n<p>\tAt<br \/>\nthis stage, Mr. Harin P. Raval, learned counsel for the appellant,<br \/>\nsubmits that the appellant may be given sometime to vacate the<br \/>\nsuit-premises.\n<\/p>\n<p>\tSince<br \/>\nthis Appeal is filed only by original defendant no.1 and the decree<br \/>\nof eviction was passed inter alia on the ground that the<br \/>\nsuit-premises were sub-let by the appellant&#8217;s father to defendant<br \/>\nnos. 2 and 3 (present respondent nos. 6 and 7), it would be for the<br \/>\nconcerned parties, who are in possession of the suit premises, to<br \/>\nmove the executing court with such a request.\n<\/p>\n<p>\tThe<br \/>\nLetters Patent Appeal, therefore, deserves to be dismissed and is<br \/>\nhereby dismissed.\n<\/p>\n<p>(M.S.\n<\/p>\n<p>SHAH, Actg.
