SAHAI\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 04\/10\/2011 \nORAL ORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE KS JHAVERI)<\/p>\n<p>\tWhile<br \/>\nadmitting this Civil Application on 10.03.2004, this Court has passed<br \/>\nthe following order :-\n<\/p>\n<p>&#8220;Rule.\n<\/p>\n<p> The Gujarat Universities Services Tribunal holds that the appellant<br \/>\nis to be treated at par with the teachers who retired at the age of<br \/>\n62 years.   Therefore, the  petitioner was to continue in service<br \/>\nupto 62 years. However, the Single Judge holds otherwise.  After<br \/>\nhearing the learned counsel for the appellant, we find  substance in<br \/>\ncontention that the appellant has to be treated at par with  teachers<br \/>\n who  retired  at  the  age  of  62 years, therefore, liable to<br \/>\nsuperannuation  at  the  age  of  62 years.    Consequently,<br \/>\ndeducting\/  withholding  retiral benefits would cause serious<br \/>\ninjustice to him  and  throw him at the verge of starvation, as<br \/>\ncontended.  Subject to final  order,  the  respondents are therefore<br \/>\ndirected to release retiral benefits of the appellant withheld by  it<br \/>\nwithout  making  adjustment  of  Rs.4  lacs as per Single Judge<br \/>\norder, because the appellant  remained  in  service during this<br \/>\nperiod pursuant to the Court orders. Direct  Service  on  respondents\n<\/p>\n<p> &#8211;  1,  2 &amp; 3 is permitted.\n<\/p>\n<p>Respondent-4 be served by normal service.&#8221;\n<\/p>\n<p>\tIn view of the above order, no<br \/>\nfurther order is required to be passed in the present Civil<br \/>\nApplication.  The present Civil Application accordingly stands<br \/>\ndisposed of in the above terms.\n<\/p>\n<p>\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t[V. M.
