Justice M.SASIDHARAN NAMBIAR\n\n Dated :22\/10\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n\n            ---------------------------------------------\n            CRL.M.C.NO.4156 OF 2010\n            ---------------------------------------------\n            Dated         22nd    October, 2010\n\n\n                           O R D E R\n<\/pre>\n<p>           Petitioner, the second accused in<\/p>\n<p>C.P.160\/2002 on the file of Judicial First<\/p>\n<p>Class Magistrate&#8217;s Court, Mavelikara did not<\/p>\n<p>appear  at  the      committal              stage.        Therefore,<\/p>\n<p>case  against     him        was       split          up  and  case<\/p>\n<p>against  first        accused             was         committed  to<\/p>\n<p>Additional  Sessions             Court,           Mavelikara    and<\/p>\n<p>taken     on     file         as        S.C.159\/2004.            By<\/p>\n<p>Annexure-A2     judgment                learned           Additional<\/p>\n<p>Sessions Judge acquitted the first accused<\/p>\n<p>finding that prosecution                 failed to prove the<\/p>\n<p>case. When petitioner appeared subsequently,<\/p>\n<p>the case against him was committed to the<\/p>\n<p>Sessions  Court.        It      is      now        pending    before<\/p>\n<p>Additional     Sessions                Court,            Mavelikara.<\/p>\n<p>Crmc 4156\/10<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>Petition is filed under Section 482 of Code of<\/p>\n<p>Criminal      Procedure  to  quash  the proceedings<\/p>\n<p>against him contending that in view of the<\/p>\n<p>findings      in  Annexure-A2  judgment that  whole<\/p>\n<p>prosecution case is        clouded with suspicion,<\/p>\n<p>continuation of the proceedings will serve no<\/p>\n<p>purpose,      as   there   is   no   likelihood  of<\/p>\n<p>conviction and therefore, the case is to be<\/p>\n<p>quashed.\n<\/p>\n<p>            2.   Learned  counsel appearing for the<\/p>\n<p>petitioner and learned Public Prosecutor       were<\/p>\n<p>heard.\n<\/p>\n<p>            3. As held by the Full Bench of this<\/p>\n<p>Court in <a href=\"\/doc\/217622\/\">Moosa v. Sub Inspector of Police<\/a> (2006<\/p>\n<p>(1)     KLT   552),   based  on   the  judgment  of<\/p>\n<p>acquittal      of  the  co-accused,  an  absconding<\/p>\n<p>accused is not entitled to get the case against<\/p>\n<p>him quashed.       True, Annexure-A2 judgment shows<\/p>\n<p>Crmc 4156\/10<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>that based on the evidence recorded, learned<\/p>\n<p>Additional        Sessions    Judge    found    that<\/p>\n<p>prosecution       case is clouded with suspicion.<\/p>\n<p>But    based    on  that  finding  case  cannot  be<\/p>\n<p>quashed.
