The said petitions were preferred by the<br \/>\npresent appellants to challenge the action of the respondents of not<br \/>\ngiving employment to them though their names figured at serial Nos.8,<br \/>\n9, 10, 12 &amp; 16 respectively in the select list. The grievance of<br \/>\nthe appellants is that there were six vacancies of Education<br \/>\nInspectors for direct recruit at the time when the advertisement was<br \/>\ngiven. However, the advertisement was for filling up 18 vacancies and<br \/>\nthe respondent-authorities gave appointment upto serial No.6 and then<br \/>\nstopped giving appointment. Therefore, the petitions.\n<\/p>\n<p>2.\tLearned<br \/>\nadvocate Mr.Mishra for the appellants submitted that the<br \/>\nrespondent-authorities have not adopted a transparent course of<br \/>\naction and have not disclosed the backlog of the vacancy.\n<\/p>\n<p>3.\tThe<br \/>\nlearned Single Judge, after considering various contentions raised by<br \/>\nthe petitioners, dismissed the petitions holding that the petitioners<br \/>\ndo not enjoy any right of the appointment only because they are<br \/>\nplaced on the select list. In this context, reliance was placed on<br \/>\nthe decision in the case of Government of Orissa, through<br \/>\n<a href=\"\/doc\/1932449\/\">Secretary, Commerce and Transport Department, Bhubaneshwar v.<br \/>\nHaraprasad Das and Ors,<\/a> (1998)1 SCC 487.\n<\/p>\n<p>4.<br \/>\nWe are in agreement with the view taken by the learned Single Judge.<br \/>\nWe do not find any reason for interfering with the judgment impugned<br \/>\nin the appeals. The appeals do not merit acceptance.
