NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     We have heard Learned counsel for both the parties.<br \/>\n     This appeal  by special  leave arises from the judgment<br \/>\nof the\tsingle Judge  of the  Rajasthan High  Court made  on<br \/>\nNovember 4,  1992 in  S.A No  175 of 1992. The Learned Judge<br \/>\ndismissed the  second appeal  on the  ground of limitation .<br \/>\nAfter hearing  the learned  counsel for\t both  the  parties,<br \/>\ninstead of  remanding the  matter, we  think that  it can be<br \/>\ndisposed of  on merits.\t  The respondent was appointed on ad<br \/>\nhoc basis  as a\t teacher on September 30,1970. The Screening<br \/>\nCommittee constituted  to regularise  the services of the ad<br \/>\nhoc teachers  found that  the respondent  was not  fit to be<br \/>\nconfirmed. On  the basis  thereof, the\torder of termination<br \/>\ncame to\t be made  on May  8 1974.  It was  challenged in the<br \/>\nsuit. Ultimately, when it was decreed by the trial Court and<br \/>\naffirmed by  the appellate  Court, the\tHigh Court dismissed<br \/>\nthe second  appeal on the ground of limitation. The District<br \/>\nJudge relied  upon Rule\t 23A of the Rajasthan Service Rules,<br \/>\n1951 to\t hold that prior notice required by Rule 23A was not<br \/>\ngiven to  terminate the service. So the order is bad in law.<br \/>\nRule 6(b)(3) of the Rules provides thus;\n<\/p>\n<blockquote><p>     &#8221; Rule  6(b)(3)  &#8211;\t that  a  person<br \/>\n     holding any  of the following grade<br \/>\n     I post in sections B,C,D,E and F or<br \/>\n     any of  the posts in section &#8220;A&#8221; of<br \/>\n     the scheduled  on 31.12.72 in an ad<br \/>\n     hoc \/officiating\/temporary capacity<br \/>\n     and who  had continuously\thold the<br \/>\n     said post or would have held any of<br \/>\n     these posts  put fFp his deputation<br \/>\n     elsewhere, for  a period  not  less<br \/>\n     than six  months on  15-12-1971 and<br \/>\n     was working  as such on the date of<br \/>\n     publication  of  these  (amendment)<br \/>\n     Rules  shall   be\tscreened   by  a<br \/>\n     committee referred\t to in\tRule 25,<br \/>\n     for adjudging  his suitability  for<br \/>\n     such post,\t provided  he  possesses<br \/>\n     the  qualifications  prescribed  in<br \/>\n     the   rules   either   for\t  direct<br \/>\n     recruitment or for promotion or the<br \/>\n     prescribed\t qualification\t of  the<br \/>\n     posts on  the basis of which he was<br \/>\n     appointed\tin   the   ad\thoc   or<br \/>\n     officiating or  temporary\tcapacity<br \/>\n     on such post.&#8221;<\/p><\/blockquote>\n<p>     Under Rule\t 25, Screening\tCommittee was  appointed  to<br \/>\nadjudge\t  the\tsuitability   of   ad\thoc   teachers\t for<br \/>\nregularisation. As  a consequence  of the  above  rule,\t the<br \/>\nScreening Committee  considered the persons holding posts on<br \/>\ntemporary or officiating basis or in ad hoc capacity who had<br \/>\ncontinuously held the post for a period of not less than six<br \/>\nmonths as  on December\t15, 1971 and were working as such on<br \/>\nthe date  of the  publication of the Amendment of the rules.<br \/>\nThey were required to be screened by a Committee constituted<br \/>\nunder Rule  25 to  adjudge their  suitability to  the  posts<br \/>\nprovided they possess the qualification prescribed under the<br \/>\nRule either  for the  direct recruitment or for promotion or<br \/>\nthe prescribed\tqualification of  the posts  on the basis of<br \/>\nwhich they  were appointed  in\tad  hoc\t or  officiating  or<br \/>\ntemporary   capacity.\t Admittedly,   the   Committee\t was<br \/>\nconstituted in\t1974 under Rule 25 and the Committee came to<br \/>\nthe conclusion\tthat  the  respondent  was  not\t fit  to  be<br \/>\nconfirmed. Rule\t 23A was  inserted w.e.f. July 10,1981. Rule<br \/>\n23A (2)(a) reads as under:\n<\/p>\n<blockquote><p>     &#8220;The   service   of   a   temporary<br \/>\n     Government servant\t who has been in<br \/>\n     continuous Government  services for<br \/>\n     more  than\t  three\t years\tand  who<br \/>\n     satisfied\t the\tsuitability   in<br \/>\n     respect of\t age and  qualifications<br \/>\n     prescribed for  the  post\tand  has<br \/>\n     been appointed in consultation with<br \/>\n     the   Rajasthan\tPublic\t Service<br \/>\n     Commission\t where\tsuch  liable  to<br \/>\n     termination at any time by a notice<br \/>\n     of three  moths  given  in\t writing<br \/>\n     either by the Government servant to<br \/>\n     the appointing  authority or by the<br \/>\n     appointing\t  authority    to    the<br \/>\n     Government servant:\n<\/p><\/blockquote>\n<blockquote><p>     Provided that  the service\t of  any<br \/>\n     such  Government\tservant\t may  be<br \/>\n     terminated forthwith,  and on  such<br \/>\n     terminated forthwith,  and on  such<br \/>\n     termination the  Government servant<br \/>\n     shall be  entitled to  claim a  sum<br \/>\n     equivalent to the amount of his pay<br \/>\n     plus   allowances for the period of<br \/>\n     notice at the same rate at which he<br \/>\n     was drawing  immediately before the<br \/>\n     termination of  his service for the<br \/>\n     period by\twhich such  notice falls<br \/>\n     short of  three months, as the case<br \/>\n     may be&#8221;.<\/p><\/blockquote>\n<p>     Therefore, Rule  23(2) per\t se was\t inapplicable.\tEven<br \/>\notherwise, assuming  that it  was applicable, it would apply<br \/>\nto  a  case  where  consultation  with\tthe  public  service<br \/>\ncommission is  necessary and  the public  service commission<br \/>\nfinds the  Government servant not eligible to be confirmed.;<br \/>\nIn such\t a case,  termination of  the services could be made<br \/>\nonly after  giving three months notice in writing. In such a<br \/>\ncase, termination  of the  services could be made only after<br \/>\ngiving three  months notice  in writing.  In this  case, the<br \/>\nScreening committee  was constituted.  it is obviously not a<br \/>\ncase covered under Section 23A for obtaining the concurrence<br \/>\nof the Public Service Commission. Under those circumstances,<br \/>\nthe view  of the  courts below\twas obviously incorrect. The<br \/>\nHigh Court  was incorrect  in dismissing  the appeal  on the<br \/>\nground of delay.\n<\/p>\n<p>     The appeal\t is accordingly\t allowed. The  order of\t the<br \/>\ncourts below stands set aside.
