JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n\t  \nDate : 01\/07\/2008 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tWhen<br \/>\nthe matter is taken up today, Mr. Devang Bhatt, learned advocate for<br \/>\nMr. P.S. Champaneri, learned counsel for the petitioners, has<br \/>\ntendered a copy of the order dated 7th August, 2007 of the<br \/>\nDivision Bench of this Court in Special Civil Application No. 23091<br \/>\nof 2006 and has submitted that in view of the above order, the writ<br \/>\npetition does not survive. It is further prayed by the learned<br \/>\ncounsel for the petitioners that this Court may issue directions,<br \/>\nsimilar to the ones issued by the Division Bench in paragraph 7 of<br \/>\nthe above mentioned order. The order dated 7th August,<br \/>\n2007 in Special Civil Application No. 23091 of 2006 is taken on the<br \/>\nrecord of the case.\n<\/p>\n<p>2.\t\tThe<br \/>\ngrievance of the petitioners is that the respondent no. 3 has<br \/>\ndemanded an amount of Rs.1,20,327\/- towards the educational cess and<br \/>\nproperty tax from the petitioners. By order dated 7th<br \/>\nAugust, 2007, passed in Special Civil Application No. 23091 of 2006,<br \/>\nthe levy of educational cess and property tax in respect of the<br \/>\nproperty of the petitioners in that case, has been upheld by the<br \/>\nDivision Bench and the same principles of law will apply to the case<br \/>\nof the petitioners. However, while disposing of Special Civil<br \/>\nApplication No. 23091 of 2006, the Division Bench has directed that<br \/>\nthe petitioners therein shall pay the amount of educational cess and<br \/>\nproperty tax and arrears thereof, in 12 equal monthly installments.<br \/>\nSimilar  directions can be passed in the preset case, as well.\n<\/p>\n<p>2.1.\n<\/p>\n<p> It is, therefore, directed that the petitioners will pay the amount<br \/>\nof educational cess and property tax  as well as arrears accruing<br \/>\nthereupon, till date, in 12 equal monthly installments, commencing<br \/>\nfrom 1st August, 2008 and an undertaking to this effect<br \/>\nshall be filed by the petitioners on or before 15th July,<br \/>\n2008.\n<\/p>\n<p>2.2.\n<\/p>\n<p>In case the petitioners commit breach of the above undertaking and<br \/>\nthere is any default in payment of any installments, the respondent<br \/>\nauthorities will be at liberty to make the recovery in accordance<br \/>\nwith law.\n<\/p>\n<p>3.\t\tSubject<br \/>\nto the above directions, the petition is disposed of. Notice is<br \/>\ndischarged.
