On 1.11.1993,<br \/>\n\tpetitioner gone on medical leave upto 30.6.1994. On 1.7.1994, he<br \/>\n\tresumed duty with medical certificate issued by Resident Medical<br \/>\n\tOfficer, General Hospital, Surendranagar. However, he was not<br \/>\n\tallowed to join. Petitioner addressed letters to authority with a<br \/>\n\trequest to allow him to join duty. Branch Manager replied him that<br \/>\n\tdecision to that effect was pending with Regional Manager. Again<br \/>\n\tseveral correspondences made by the petitioner to take decision at<br \/>\n\tthe earliest. On 30.6.1995 petitioner retired on attaining age of<br \/>\n\tsuperannuation. It is also the case of the petitioner that after<br \/>\n\tretirement he was paid gratuity and provident fund, but is still not<br \/>\n\tpaid pension. He sent notice on 21.3.2007 to respondent authority to<br \/>\n\tpay him pension. Since, he did not get any reply he approached this<br \/>\n\tCourt by way of filing this petition.\n<\/p>\n<p>\tThe<br \/>\n\tlearned advocate for the petitioner submitted that it is a matter of<br \/>\n\trecord that the petitioner reported for duties after sick leave.<br \/>\n\tHowever, though he was available for duty, he was not allowed to<br \/>\n\tdischarge his duties. Nor the petitioner was paid salary for the<br \/>\n\tperiod he was not allowed to be joined on duty though he was willing<br \/>\n\tto do the work. The petitioner is deprived of pension which is<br \/>\n\tfundamental right of each employee.\n<\/p>\n<p>\tLearned<br \/>\n\tcounsel for the respondent has drawn the attention of the Court to<br \/>\n\tPara-4(iv) of affidavit-in-reply filed by respondent authority which<br \/>\n\treads as under:-\n<\/p>\n<p>?S4[IV]<br \/>\n\t\t\tThe Present Division at Head Office of the Bank at New Delhi, vide<br \/>\n\t\t\tcirclar No.1431 dated 27.6.1994 circulated the proposed Punjab<br \/>\n\t\t\tNational Bank Employees Pension Scheme, 1993 and options were<br \/>\n\t\t\tcalled for from the employees. The petitioner exercised his option<br \/>\n\t\t\ton 29.9.1994. A copy of the form exercising the option for pension<br \/>\n\t\t\tby the petitioner, is annexed hereto and marked as  ANNEXURE-R-4.<br \/>\n\t\t\tThereafter, Personnel Division at Head Office of the Bank at New<br \/>\n\t\t\tDelhi, vide circular No.1520 dated 15.11.1995, circulated the<br \/>\n\t\t\tapproved pension Scheme ?SPunjab National Bank Employees) Pension<br \/>\n\t\t\tRegulations 1995?? and called for options from the employees. As<br \/>\n\t\t\tper para 3(i)(d) of the said Regulations, the employees were<br \/>\n\t\t\trequired to exercise the option in writing within 120 days from<br \/>\n\t\t\tthe Notified dates to become member of the fund. As the petitioner<br \/>\n\t\t\thas exercised the option, the Competent Authority has agreed to<br \/>\n\t\t\tsanction pension in terms of provisions of PNB (Employees) Pension<br \/>\n\t\t\tRegulations, 1995.??\n<\/p>\n<p>\tHeard<br \/>\n\tthe learned advocates for both the sides. Having gone through the<br \/>\n\trecord more particularly para-4(iv) of affidavit in reply filed by<br \/>\n\trespondent authority, it transpires that the petitioner has gone for<br \/>\n\tscheme of ?SPunjab National<br \/>\n\tBank (Employees) Pension Regulations 1995 and, therefore, he is<br \/>\n\tentitled to pay pension as per that scheme only. However, if the<br \/>\n\tpetitioners is not paid pension as above stated scheme, such payment<br \/>\n\twill be made to the petitioner within eight weeks on receipt of copy<br \/>\n\tof writ of this order.\n<\/p>\n<p>\tIn<br \/>\n\tview of the above, petition is partly allowed as regards question of<br \/>\n\tunpaid pension to the petitioner. For rest of the issues involved in<br \/>\n\tthe petition, this Court is not entertaining the petition in view of<br \/>\n\tdecision of the Hon&#8217;ble Supreme Court reported in AIR<br \/>\n\t2007 SC 1330 in case of Shiv<br \/>\n\tDaas v.
