The<\/p>\n<p>                   defendant is the petitioner in an application under Section<\/p>\n<p>                   115 of the Code of Civil Procedure and is aggrieved by the<\/p>\n<p>                   order dated 21.8.2007, passed by the learned Sub Judge III,<\/p>\n<p>                   Siwan, whereby the application filed by the defendant to<\/p>\n<p>                   consider the preliminary objection raised by him at the<\/p>\n<p>                   preliminary stage has been rejected, and it has been ordered<\/p>\n<p>                   that the same shall be considered at the time of disposal of<\/p>\n<p>                   the suit.\n<\/p>\n<p>                               2. Learned counsel for the defendant (the<\/p>\n<p>                   petitioner) submits that in order to avoid wastage of public<\/p>\n<p>                   time and money the court should always strive to dispose of<\/p>\n<p>                   matters at the preliminary stage. He relies on my judgment<\/p>\n<p>                   in the case of Dilip Gupta v. Debashish Palit [2005 (3)<\/p>\n<p>                   PLJR 623] (para- 27).\n<\/p>\n<p>                               3. Learned counsel for the plaintiff (the opposite<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>      party) submits that the hearing of the suit has already<\/p>\n<p>      concluded in March 2010 which renders the present civil<\/p>\n<p>      revision application infructuous.\n<\/p>\n<p>                4.   We have perused the materials on record and<\/p>\n<p>      considered the submissions of the learned counsel for the<\/p>\n<p>      parties. In view of the statements of Mr. Shashi Shekhar<\/p>\n<p>      Dwivedi, learned counsel for the plaintiff, that the hearing<\/p>\n<p>      of the suit has concluded in March 2010, and now oral<\/p>\n<p>      arguments have to commence, this civil revision application<\/p>\n<p>      has become infructuous.
